SUBSEQUENT RENEWAL OF RENEWED FULL-POWER OPERATING LICENSES FOR TURKEY POINT NUCLEAR GENERATING UNIT NOS. 3 AND 4 The staff has completed its safety and environmental reviews of the Subsequent License Renewal Application for Turkey Point Unit Nos. 3 and 4 (Turkey Point) consistent with the schedule and milestones established in response to the Nuclear Energy Innovation and Modernization Act. The staff requirements memorandum (SRM) for SECY-02-0088, Turkey Point Nuclear Plant, Units 3 and 4, Renewal of Full-Power Operating Licenses, dated June 5, 2002 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML021560479), authorizes the Director of the Office of Nuclear Reactor Regulation (NRR) to issue all future uncontested license renewals without prior Commission authorization once the Director of NRR has made the appropriate findings. In accordance with the SRM for COMSECY-05-0025, Renewal of Full-Power Operating License for Arkansas Nuclear One, Unit 2, dated July 25, 2005 (ADAMS Accession No. ML052060234), the staff is informing the Commission that it plans to issue Subsequent Renewed Facility Operating License Nos. DPR-31 and DPR-41 for Turkey Point, on or after December 3, 2019.

By letter dated January 30, 2018, Florida Power and Light Company submitted an application to renew the Renewed Facility Operating License Nos. DPR-31 and DPR-41 for Turkey Point (ADAMS Accession No. ML18037A812), as supplemented by letters dated February 9, 2018 (ADAMS Accession No. ML18044A653); February 16, 2018 (ADAMS Accession No. ML18053A123); March 1, 2018 (ADAMS Accession No. ML18072A224); and April 10, 2018 (ADAMS Accession Nos. ML18102A521 and ML18113A132). The staff reviewed the subsequent license renewal application in accordance with Title 10 of the Code of Federal Regulations (10 CFR) Part 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions, and 10 CFR Part 54, Requirements for Renewal of Operating Licenses for Nuclear Power Plants.

The Commissioners The staff documented the results of its safety review in its Safety Evaluation Report Related to the Subsequent License Renewal of Turkey Point Nuclear Generating Unit Nos. 3 and 4, issued July 22, 2019 (ADAMS Accession No. ML19191A057).

As of the date of this memorandum, the adjudicatory proceeding before the Atomic Safety and Licensing Board (ASLB) has been terminated by the ASLB in accordance with the ASLBs Memorandum and Order issued October 24, 2019 (LBP-19-8) (ADAMS Accession No. ML19297F366). The intervenors August 9, 2019, petition for review of LBP-19-3 and LBP-19-6 is pending before the Commission, together with the ASLBs referred ruling contained in LBP-19-3. In addition, the intervenors filed a petition for review of the ASLBs decision in LBP-19-8 on November 18, 2019.

The staff documented the results of its environmental review in a final supplemental environmental impact statement, made publicly available on October 25, 2019, as NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants, Supplement 5, Second Renewal, Regarding Turkey Point Nuclear Generating Unit Nos. 3 and 4, Final Report (ADAMS Accession No. ML19290H346). The staff informed the Commission and parties of the availability of the Final Supplemental Environmental Impact Statement (FSEIS) on October 28, 2019; accordingly, the staff calculates that interested parties have until November 27, 2019, to file contentions on the final supplemental environmental impact statement, per the schedule set forth in the ASLBs Initial Scheduling Order of March 21, 2019 (ADAMS Accession No. ML19080A209).

Additionally, the Environmental Protection Agency (EPA) has until December 2, 2019, to review and comment on the FSEIS. Due to EPAs participation during the comment period for the draft environmental impact statement, the staff does not anticipate any additional comments on the FSEIS, although this is still unknown.

In accordance with 10 CFR 54.25, Report of the Advisory Committee on Reactor Safeguards, the Advisory Committee on Reactor Safeguards (ACRS) reviewed the subsequent license renewal application for Turkey Point. During its September 4, 2019, meeting, the ACRS completed its review, and documented its findings recommending subsequent renewal of the Turkey Point renewed licenses in a letter to the Commission dated October 7, 2019.

The U.S. Nuclear Regulatory Commission staff has determined that although the subsequent renewed licenses for Turkey Point will become effective immediately upon issuance, the staffs proposed action would not foreclose or prejudice Commission action on the pending appeals or a subsequent petition for judicial review. Therefore, unless otherwise directed, the Director of NRR intends to issue Subsequent Renewed Facility Operating License Nos. DPR-31 and DPR-41 for Turkey Point, on or after December 3, 2019.
