June 13, 2016 CITIZENS ALLIED FOR SAFE ENERGY REQUEST FOR FILING DATE CLARIFICATION FOR PETITION FOR REVIEW On May 31, 2016 this Board issued an Initial Decision in the subject matter which states, at 56, 57 NRC regulations require that any petition for review must be filed within 25 days from service of this Initial Decision.

However, since that date falls on Saturday, June 25, 2016, the following provision of this Boards Scheduling Order of May 8, 2016, at 2, would seem to apply:

Consistent with 10 C.F.R. § 2.306(a), if any deadline prescribed by this scheduling order would fall on a Saturday, Sunday, Federal legal holiday, or a day on which NRC headquarters is not open for business due to an emergency closure of the Federal Government in Washington, D.C., then such deadline will be considered to fall on the next day that is not a Saturday, Sunday, Federal legal holiday, or 1

emergency closure.

Therefore, CASE will assume that the final filing date for a Petition For Review will be Monday, June 27, 2016 Executed in Accord with 10 CFR § 2.304(d).
