Dear Administrative Judges:
The NRC Staff wishes to inform the Atomic Safety and Licensing Board (Board) and parties that the U.S. National Marine Fisheries Service (NMFS) has issued its final concurrence letter regarding the impacts of subsequent license renewal of Turkey Point Nuclear Generating Unit Nos. 3 and 4. Enclosed herewith is a letter from David Bernhart (NMFS) to Briana Grange (NRC), dated October 22, 2019, transmitting its concurrence with the NRC Staffs determinations under the Endangered Species Act (ESA) with respect to species and habitats under the NMFSs jurisdiction. In its letter, the NMFS concluded, in part, as follows:
Because all potential project effects to listed species were found to be discountable, insignificant, or beneficial, we conclude that the proposed action is not likely to adversely affect listed species under NMFSs purview. This concludes your [NRCs] consultation responsibilities under the ESA for species under NMFSs purview.
Id. at 11. As indicated therein, the NMFSs letter concludes its consultation with the NRC under Section 7(a)(2) of the ESA with respect to federally listed species and habitats under the NMFSs jurisdiction. A copy of NMFSs letter is enclosed herewith and is available in the NRCs

In addition, the NRC Staff wishes to inform you that it is preparing to issue the Final Supplemental Environmental Impact Statement (FSEIS) for subsequent license renewal of Turkey Point Units 3 and 4 (Generic Environmental Impact Statement for License Renewal of Nuclear Plants, Supplement 5, Second Renewal, Regarding Subsequent License Renewal for Turkey Point Nuclear Generating Unit Nos. 3 and 4 (NUREG-1437, Supplement 5, Second Renewal)). The NRC Staff expects to notify the Board and parties of the FSEISs availability on or before October 28, 2019.
