Kurshad, I understand. I will place your email and this email in ADAMS to explain the change. I will send a correction email out to all those on distribution.

Please be aware, that I will be asking NRC management to inform EPRI that you will be expected to respond to RAIs and other requests within 30 days (as other vendors and applicants are expected to do) in order to meet 10 CFR Part 2.108:

2.108 Denial of application for failure to supply information.

(a) The Director of Nuclear Reactor Regulation or Director of Nuclear Material Safety and Safeguards, as appropriate, may deny an application if an applicant fails to respond to a request for additional information within thirty (30) days from the date of the request, or within such other time as may be specified.

Consistent with the pertinent provisions of 10 CFR 50 Appendix B, no quality assurance work will begin with a draft input. Therefore, formal engagement of the engineering/licensing teams would not begin until official RAIs are received.

Lois, I was able to download from the Box both the proprietary and non-proprietary attachments to your email communication to Dr. Aylin Kucuk, dated March 21, 2025. However, your email is inconsistent with the timeline we have communicated earlier. As I replied to your email on February 26 (attached), EPRI would respond to the FFRD RAIs within 90 days of the issuance of the letter. Your revised email shows 60 days instead of 90-day response time. This is not consistent with our communication. Please clarify the basis of this change from the ML25049A043 memo. I contest the statement implying that I have agreed to a shorter period for the response. Since March 3, we are trying to get the official copies of the proprietary attachment which finally came today.

Please make the necessary correction so that we can be all on the same page with respect to the formal timeline. If you would like to further discuss a solution, please do not hesitate to call me. My numbers is listed below.

3 Lois and James, As of today, EPRI has not received the formal RAIs for the ALS review. This complicates our ability to engage our contractor, Westinghouse, to begin working on the responses. Although the cover letter was dated February 26th, we believe the 90-day period for providing formal responses to the RAIs should commence from the date the formal RAIs are communicated, rather than from the draft letter date. Please note that we will attempt to provide the responses as promptly as possible, but the 90-day period should be counted from the delivery of the formal RAIs.

I hope this aligns with your expectations, and we can reach a mutual understanding regarding the RAI response timeline. Please provide an estimated timeframe for sending the oicial RAIs and inform me if this situation causes any further complications.
