The Honorable Jeannette Mott Oxford Missouri House of Representatives 201 West Capitol Avenue Room 135BB Jefferson City, MO 65101-6806

Dear Ms. Oxford:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am acknowledging your letter dated November 1, 2012, to Chairman Macfarlane in which you requested that the NRC staff take additional action regarding the petition filed by Mr. Lawrence Criscione on August 15, 2012.

In a letter dated September 20, 2012, the staff informed Mr. Criscione that the NRC did not accept his petition because it did not provide new information. All the information in Mr. Criscione's petition had already been considered by the staff in his previous petitions. In your letter, you accuse the staff of "bureaucratically dismissing [his] petition by untruthfully claiming it has already been investigated..." You requested the staff's assessment of five specific questions regarding the Callaway Plant inadvertent shutdown event of October 21, 2003. In regard to your letter, the staff is determining whether or not any new information has been provided (i.e., information that the NRC staff has not previously considered). The NRC staff will provide its evaluation to the Chairman for her use in responding to you. The NRC takes its safety responsibility seriously, and we welcome opportunities to discuss nuclear safety issues in an open and collaborative manner.

In your letter, you alleged misconduct by the NRC staff. The agency has referred your concerns to the NRC Office of the Inspector General, which is charged with investigating misconduct by NRC employees.

The NRC appreciates hearing your views and thanks you for your interest in this matter. Sincerely,
