Discrepancies in documentation of operator training were identified during a special training assessment conducted in January 1983 and a special safety inspection conducted by Region II during August and September 1983.

The Region evaluated these inspections and concluded that these discrepancies were not limited to documentation errors.

The Office of Investigations J

subsequently conducted an investigation during the period October 18, 1983 through February 10, 1984. The investigation included a review of the circumstances surrounding the submittal of false and undocumented information on operator license applications.

The Commission has reviewed the results of this investigation. As a result of this review, it has concluded that violations of the Commission's requirements did occur and that enforcement action should be taken. However, the investigation report has been referred to the Department of Justice for consideration for criminal prosecution and the NRC has been asked not to release the information gathered during the investigation.

Therefore, the Commission has decided to hold in abeyance its civil enforcement action on this matter.

You will be notified of the proposed imposition of a civil penalty when the Comission i

On May 29, 1985 the Commission was informed that a ?!otice of Violation and Proposed Imposition of Civil Penalty in the amount of Five Hundred Thousand Dollars ($500,000) would be issued on or about May 31, 1985 to Mississippi Power and Light Company. This is to inform the Cormiission that the enforcement action was issued today with editorial changes in the letter to the licensee. The changes were made to remove an ambiguity in the paragraph describing the recertification of licensed operators, to acknowledge action taken by the licensee,and to correct minor grammatical errors.
