Dear Mr. Reber:
This is in further response to your letter dated June 12, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA), access to NRC records relating to " qualification cards" of operators.
The additional records listed on the enclosed Appendix A (Continued) are being placed in the PDR in folder F0!A-85-419 under your name.
The released portions of documents one, two, and three listed on the enclosed Appendix B are being placed in the PDR in, folder F01A-85-419 under your name, i
Documents one and two of Appendix B are investigatory records compiled for law enforcement purposes, and portions are being withheld from public disclosure pursuant to Exemptions (6) and (7)(C) of the F0IA (5 U.S.C. 552(b)(6) and (7)(C)) and 10 CFR 9.5(a)(6) and (7)(iii) of the Comission's regulations, c
i because disclosure of the information would constitute an unwarranted invasion i
of personal privacy. Document one of Appendix.B also contains information which constitutes advice, opinions, and recomendations of the staff of the Office of Inspector and Auditor which was provided to the NRC Comissioners i
for their predecisional consideration. This information is being withheld from public disclosure pursuant to Exemption (5) of-the F0IA (5 U.S.C.
552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.
i Portions of document three listed on the enclosed Appendix B have been deleted in order to withhold the names and personal identifiers of certain individuals.
Because disclosure of this information would constitute a clearly unwarranted invasion of personal privacy, it is being withheld from public disclosure pursuant to Exemption (6) of the F0IA (5 U.S.C. 552(b)(6)) and 10 CFR 9.5(a)(6).
Pursuant to 10 CFR 9.15 of the Comission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are Ms. Sharon R. Connelly, Director, Office of Inspector and Auditor with respect to documents one and two listed on Appendix B, and Mr. James A. Fitzgerald, Assistant General Counsel, with respect to document three listed on Appendix B.
