SUMMARY

OF SEPTEMBER 910,1997, MEETING ON PORTIONS OF THE IMPROVED TECHNICAL SPECIFICATIONS TilAT SEEK TO DELAY ENTRY INTO LIMITING CONDITIONS FOR OPERATIONS (TAC NO, M97197)

On September 9 and 10,1997, a public meetir:g was held between NRC and IES Utilities loc.

(licensee) that addressed those portions of the Duane Amold Energy Center (DAEC) Improved Technical Specifications (ITS) that seek to delay entry into Limiting Conditions for Operation (LCO) when performing surveillances required by the ITS. In addition, the NRC stafr(staf1) and the licensee representatives discussed Requests for Additional lnformation (RAls) that the staff had already transmitted to the licensee regarding the DAEC ITS Enclosure 1 is a list of attendees. Enclosure 2 is the handouts provided by the licensee in the meeting.

During the meeting, the staff stated that it did not consider the requests for LCO delay to be a safety issue. The staff has provided guidance to the industry that plants should enter applicable LCOs when performing surveillances that render inoperable equipment controlled by the Technical Specifications. This is part of the issue of standa dization that underpins the ITS concept. The staff noted that other older BWRs have gone through the conversion to ITS process and have adapted their procedures and ITS to enter LCOs when performing certain surveillances.

The staff stated that it is its policy and practice to minimize notes and to have one set of allowed outage times (AOTs) in the ITS. The staff stated it wishes to minimize the problems inspectors will have in interpreting the ITS. The staffindicated it was important that the Bases do not contradict the ITS. The staff provided guidance on the level ofjustification needed in the ITS submittal for changes categorized as "more restrictive."

During the meeting, the licensee presented its rationale for delayed entry, ne licensee discussed its safety culture at DAEC and DAEC management's desire to keep the significance for entry into an LCO as high as possible. The NRC staff stated it would only entertain a delay for those

, few cases where there was adequate technical justification for the inclusion of a delay. Where there was inadequate technical justification, the staff expects, under the ITS, that the licensee will enter the appropriate LCO if equipment is rendered inoperable during the performance of an ITS required surveillance.
