PROCEEDINGS 2 CHAIRMAN ZECH: Good afternoon, ladies and 3 gentlemen. This is an affirmation session on two matters.

4 One concerning the Braiduced plant, and the other concerning a 5 licensing decision on the Perry plant. I will ask the 6 Secretary to lead us through these two items.

! 7 MR. CHILK: The first item, Mr. Chairman, is 8 86-325A, a licensing decision for Perry. The Commission here 9 is being asked to act on an order which authorizes the NRC 10 Staff to issue a full power license for the Perry 1 Nuclear 11 Power Plant and explains the Commission's decision in the 12 matter.

13 Chairman Zech, Commissioners Roberts, Carr and 14 Bernthal have approved the order. Commissioner Asselstine has 15 disapproved and will have separate views.

18 MR. CHILK: The second item deals with Braidwood, 19 it's 86-292A. It's an order on a Board-OI dispute on the i

l 20 Braidwood proceeding. The commission here is being asked to' 21 act on an order which completes the Commission's review of the 22 dispute between the Office of Investigation and the Licensing l 23 Board in the Braidwood operating license hearing.

24 Chairman Zech, Commissioners Asselstine, Roberts, l 25 Carr and Bernthal have approved the order in which the

. 4 1 Commission rules against the disclosure of the OI materials 2 and against the issuance of a subpoena to the alleger.

3 Furthermore, applying the criteria by which 4 late-filed contentions are to be judged and a policy statement 5 on disclosure, the Commission also rules against the 6 admissibility of the late-filed contention based on the 7 alleger's claim. In order to protect the conventionality and 8 the ongoing investigation in the order imposing certajn 9 restrictions on the parties, future pleadings, being issued to 10 the parties under a protective order.
