SUBJECT:
DIFFERING PROFESSIONAL OPINION CONCERNING TECHNICAL SPECIFICATION SET POINTS AND ALLOWABLE VALUES FOR INSTRUMENTATION l In a memorandum dated March 17,1997, Mr. Frederick Burrows, Electrical Engineering Branch, NRR, expressed a differing professional view (DPV) regarding technical specifications (TS) trip setpoints (TSP) and allowable values (AV) for instrumentation. An ad hoc panel was formed to review the DPV and the panel's recommendations were subsequently submitted to the NRR staff for review. By memoranda dated July 24,1998, Mr. S. Collins informed
, Mr. Burrows and 'r. L. J. Callan, EDO, that given no compelling safety or regulatory improvement, it , not an appropriate use of either NRC or industry resources to implement the DPV panel's commendations. Mr. Collins indicated that he considered the NRR review of the DPV to l' 'oncluded and that he intended to take no further ac, tion on the DPV.
Mr. Burrows belit /ed that this resolution represented an unsatisfactory disposition of his DPV, and reque.sied by memorandum to the EDO, dated August 5,1998, that specific asoccts of this issue be further reviewed under formal Differing Professional Opinion (DPO) procedures.
By memorandum dated August 24,1998, Mr. Callan designated an ad hoc panel to review this differing professional opinion composed of C. E. Rossi(AEOD) as a management member, V. Beaston (OE) as a staff member recommended by Mr. Burrows, and myself as chair.
Paul Norjan served as 1 technical assistant to the panel The panel met with Mr. Burrows, members of the Office of the General Counsel, the Technical Specifications Branch, and the Instrumentation and Controts Branch to obtain input regarding this DPO. The panel also reviewed the documents that comprise the record of the previous panel.
The panel's report with its conclusions is attached.
