l -coordinating with the Division of Fuel Cycle and Material Safety (FC).

i i-L 'Our understanding. is that the Commission has not received a fomal request to comment on these Bills, but they are virtually identical to the proposed

. amendment introduced by Lundine last year to the FY 1980 DOE authorization -j L

!' Bill. Mr. Dircks testified on this- amendment og -May 31', '1980 before the, House Interior Subcommittee on Energy and the Environment, and a copy of l his testimony is. enclosed. After the failure of the Lundine amendment,  ;

Mr. Dircks also asked:FC to analyze the Moynihan Bill, on February 27, 1980, L' ' three weeks. before-'itL was ' introduced as. a companion Bill to Lundine's H.R.

L 6865, 'a' resurrection of last year's amendment. A copy of Mr. Cunningham's L response is. also enclosed, together with a copy of Ed Regnier's memorandum lA to FC's Charles Haughney, who prepared the memo for Mr. Cunningham's ,

! While FC did r_equest our input, the analysis of the Waste Licensing Branch i . .is not' evident in the memo to Mr. Dircks. You will note that both memoranda l carry the same date, and the points in Ed Regnier's do not appear in Cunningham's. l
