Radiation Effects Reactor, Docket 50-172 Gentlemen 1.ockheed-Georgia Company is in the process of preparing plans for de-comissioning the Radiation Effects Reactor, and has encountered certain unique problems because of the uniqueness of the facility. One nroblem is the fact that a considerable amount of relatively los level acti'ation has occurred in various items of equirnent and structures. We have been unable to determine where a situation such as this is addressed in the Code of Federal Regulations, and hence we would like an opinion from the Comission on the proposed criteria listed in the following pt.ragraphs. Guidelines for DecontamJnation_ pf, Pacilities and Friu15 ment. Prior _ g Eelease for Unrestricted Use or Temination of Licenses for Dyproduct; Source. or Srectal y,uelear Vaterial which was published by the Division of Materials Licensing on April 22, 1970, appears to be a reasonable standard fcr release of non-activated components from the reactor facility.

              -Purthermore, se understand that Guidelinen has already been used as a de-contamination standard in several reactor decomissioning programs including Hallam and Piqua. Lockheed requests the Division of Reactor Licensing to confim to lockheed that the above ,0,,pidelines -- two copies of which are attached -- is acceptsble as a decontamination standard

With regard to activated equipcent and structures, lockheed proposes to release from control all items which meet the amearable contamination standard in the above _0aidelines and which have residual radiation levels of less than 0.2 mrad /hr at i cm when measured in accordance with the above Guidelines. Lockheed-would like confintation of Comission's acceptance of these criteria for release of activated structures and equi; rent. e

Decomissioning RER, Docket No. 50-172 ReWawy Ne Cy. Gentlemen: We have been advised that representatives of the Atccie Energy Comission and of the State of Georgia conferred on February 11, 1971, en the subject of the decomissioning of the Radiation Effects Reactor (RER), and that the plan described below represents a method by which Lockheed may plan the RER decomissioning in a manner acceptable both to the Atomic Energy Comission and to the State of Georgia. The Atomic Energy Comission's recomendations were discussed in two telephone conversations between Roger Roodruff of the Division of Reactor Licensing and M. A. Dewar of Lockheed on February 11 and 12, 1971. As lockheed understands, a decomissioning plan is to be sub-mitted tha'c will include the-following elements: 1 A statement that Lockheed has disposed of, or will dispose of, all the reactor fuel by authorized means prior to submitting a request for termination of Pacility License R-86,

2. The means by which lockheed will dispose of all control rod drive mechanisms.

3 The final status of each remaining component of the reactor at the time a request is submitted for termination of Pacility License R-66. vw

The proposed amendment, which we have designated as Amendment No.10, would permit Lockheed to own but not operate RER; and the propoed change, which we have designated as Change No. 8, would reduce the surveillance and staffing requirements for the RER to levels appropriate for possession-only status.

We have evaluated the proposed status of the reactor and its components, and the adequacy of the proposed Technical Specifications that require facility

                  '            surveillance and epecify staffing requirements. During our review, we informed-

A conclude that the amendment does not present significant hazards considera-ci as not described or implicit in the safety analysis report and that there is

1. The Atomic Energy Commission ("the Commission") has found that:

A. The application for amendment dated August 14, 1970, and supplement dated January 29, 1971, comply with the requirements of the Atomic Energy Act of 1954, ss an.nded ("the Act"), and the Commission's regulations set forth in 10 CFR Chapter I; B. There is reasonable assurance that the reactor facility can be possessed in the described condition at the location designated in the application without endangering the health and safety of the public; C. Lockheed is technically and financially qualified to engage in the activities authorized by the amended license in accordance with the Commission's regulations; D. Lockheed has furnished proof of financial protection which satisfies the requirements of 10 CFR Part 140; and E. The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public.

2. Accordingly, Facility License No R-86 is amended in its entirety to read as follows:

This license applies to the Radiation Effects Reactor (RER), a heterogeneous pressurized water-type nuclear reactor (hereinsfter "the reactor") possessed by Lockheed Aircraf t Corporation located in Dawsonville, Georgia, and is described in lockheed's application for license dated February 23, 1962, and amendments thereto includ-i ing application dated August 14, 1970, and supplement dated January 29,1971 (herein "the application") . 4.- This license shall be deemed to contain and be subject to the conditions specified in Part 20,.Section 30.34 of Part 30, Section 50.54 and 50.59 of Part 50, and Section 70.32 of Part 70,10 CFR Chapter I and to all applicable provisions of the Act and to the rules, regulations and orders of the Commission now or hereaf ter in ef fect, and-to the additional conditions specified below: A. Lockheed shall : t reactivate the facility without prior approval of the Commission. B. Lockheed shall not dispose of the f acility or the property occupied by the facility without prior approval of the Commission. C. Records In addition to the records heretofore required under this license and by -applicable AEC regulations, including Section 20.401 of 10 CFR Part 20 Lockheed shall keep the following:

1. . Records of inspection of the deactivated f acility, including
                                                                        -- the results of surveys .of radioactivity levels; and
2. Records showing radioactivity released or discharged into the air or water beyond'the effective control of Lockheed as measured at or prior to:the point of such release or discharge.

3-1 1. A report of any indication or occurrence of a possible i unsafe condition relating to the facility or to the public. For each occurrence, Lockheed shall promptly notify by I telephone or telegraph the Director of the appropriate AEC Regional Compliance Of fice listed in Appendix D of 10 CFR Part 20, and shall submit within 10 days a report in writing to the Director, Division of Reactor Licensing, with a copy i to the Regional Compliance Office.

2. An annual report to the Director, Division of Reactor Licensing, of the status of the deactivated f acility including the results of the surveys of radioactivity levels and the status of the special nuclear and byproduct materials stored on the Lockheed
                                    , Aircraft reactor f acility site.           The first report shall be filed six months af ter issuance of this amended f acility license and once a year thereaf ter until such time as Lockheed files with the Commission's Division of Reactor Licensing its plan for dismantling of the facility, pursuant to Section 50.82-of 10 CFR Part 50, and receives Commission approval thereof.

E. Technical Specifications The Technical Specifications contained in Appendix A to this license (hereinaf ter "the Technical Specifications") (designated as Change No. 8) are hereby incorporated in this license. No changes shall be made in the Technical Specifications except as otherwise permit-ted by this license, by the Act and by the Commission's rules and regulations, except that Lockheed may dispose of component parts or devices from the facility in accordance with the provisions of 10 CFR Part 20. The Radiation Ef fects Reactor has been shutdown and further operation is not planned. The fuel has been unloaded and is stored in the storage pool in authorized criticality-safe containers.
