THREE MILE ISLAND UNIT 1 - COMPLETION OF NRC ACTIVITIES RELATED TO RELIEF REQUEST 14R-01 CONCERNING THE EXPANDED APPLICABILITY FOR USE OF ASME CODE CASE N-513-2 (TAC NO. ME4518)

Dear Mr. Pacilio:

By letter dated August 10,2010 (Agencywide Documents and Access Management System (ADAMS) Accession No. ML102290162), Exelon Generation Company, LLC (the licensee) requested relief from certain American Society of Mechanical Engineers Boiler and Pressure Vessel Code (ASME Code) requirements at Three Mile Island, Unit 1 (TMI-1). Specifically, the licensee submitted relief request 14R-01 because ASME Code Case N-513-2, Evaluation Criteria for Temporary Acceptance of Flaws in Moderate Energy Class 2 or 3 Piping, had expired and was therefore not allowed for use during the fourth 1O-year interval inservice inspection program at TMI-1. By letter dated October 29, 2010, this request was withdrawn (ADAMS Accession No. ML103020445). The request was withdrawn because Code Case N-513-3, Evaluation Criteria for Temporary Acceptance of Flaws in Moderate Energy Class 2 or 3 Piping, has been approved for use in Regulatory Guide 1.147, Revision 16 published in the Federal Register on October 5, 2010 (75 FR 61321). Based on the licensee's withdrawal of this relief request, TAC No. ME4518 is being closed.
