UNION OF CONCERNED SCIENTISTS'/NYPIRG RESPONSE TO LETTER FROM P.J. AMICO, May 2,1983 The parties were invited to respond to a letter of May 2, 1983 from Paul J. Amico, the Board's consultant, outlining his preliminary views on issues related to accident probability requiring additional testimony.

l We wish only to add a few thoughts.

First, there is nothing in Mr. Amico's list of subject areas which should come as any surprise. On the contrary, the Intervenors raised most of these issues during the hearings (e.g., the failure of the PRA to treat sabotage, the failure to account for stress and aging factors, the great 1

l uncertainty associated with external events.) The Licensees and the Staff had virtually unlimited financial resources and the fullest possible opportunity to present their best case on all of the subjects raised by Mr. Amico.

Opening the record would simply be a vehicle for allowing those parties who presented probabilistic risk assessments a second bite at the apple after spelling out in advance all of the areas in which their initial case was unconvincing. We note that the Intervenors were not similarly invited to try their case a second time. This process is fundamentally unfair and, moreover, presupposes that the intended end result is vindication of an Indian Point PRA. Thus, the outcome is pr'ejudged.

If the witnesses sponsoring PRA results failed to justify their conclusions (and the Amico letter supports such a conclusion, in our view),

then the Intervenors should prevail in their position that the risk estimates presented by the Licensees and Staff are too uncertain to be considered reliable.

Perhaps most objectionable is Mr. Amico's suggestion that the Board should await the results of research into the source term. Such results will almost certainly not be available in usable form until late 1984 at the earliest. This case has been pe.nding for almost three years. Surely we are not seriously expected to wait another year and a half to see if NRC comes to the conclusion of ongoing research.

This case must come to an end. The Intervenors, as the other parties, have been made acutely aware of the Board's desire to expedite the hearings in this case, which necessitated limiting our witnesses and time for questioning.

We urge the Board to reach a decision on the basis of the record as it stands.

There is no justification for allowing the proponents of PRA yet another chance to prove their case.
