Partial Withdrawal of Request for Exemption from Work Hour Requirements of 10 CFR 26.205(d)(7) for Individuals Performing Duties Described in 10 CFR 26.4(a)(5)

On August 16, 2013, the Omaha Public Power District (OPPD) submitted a request (Reference 2) for an exemption from requirements of paragraph 26.205(d)(7) of Title 10 of the Code of Federal Regulations (10 CFR) for Fort Calhoun Station, Unit No.1. Reference 2 requested an exemption from specific requirements of 10 CFR 26.205(d)(7), to allow the use of the less restrictive work hour limitations described in 10 CFR 26.205(d)(4) and (d)(5) to support activities required for plant startup Employment with Equal Opportunity

In Reference 3, the NRC determined that additional information was needed before the staff could begin a detailed review of the Reference 2 exemption request and OPPD provided its response in Reference 4. References 5 and 7 transmitted additional NRC requests for information to which OPPD responded in References 6 and 8 respectively.

Following a teleconference with NRC Staff on October 25, 2013, OPPD requests to withdraw the portion of its request contained in Reference 2 and Reference 8 for exemption from the work hour requirements of 10 CFR 26.205(d)(7) for individuals performing duties described in 10 CFR 26.4(a)(5)

(Le., personnel performing security duties). OPPD continues to request that the exemption apply to individuals performing duties described in 10 CFR 26.4(a)(1) through (a)(4). This would change the limitation proposed in Reference 8 to read as follows:

Because the exemption is tied to activities that directly relate to heating the reactor coolant Teold greater than 210°F (i.e., exiting Mode 4 or 5), the exemption is being issued coincident with the date that OPPD intends to heat the reactor coolant Teold greater than 210°F (i.e., exit Mode 4 or 5). Further, the exemption is granted to those individuals who perform duties described in 10 CFR 26.4(a)(1) through (a)(4) that, as of the date of this exemption, have not exceeded a 48 hour5.555556e-4 days <br />0.0133 hours <br />7.936508e-5 weeks <br />1.8264e-5 months <br /> average work week for the 6 week period prior to the date of this exemption.
