UNXTED STATES ATOMXC ENERGY COMMISSION DOCKET NO. 50-410 NIAGARA MOHAWK POWER CORPORATION NOTICE OF RECEIPT OF APPLICATXON FOR CONSTRUCTION PERMIT AND FACILITY LICENSE AND APPLICANT'S ENVXRONMENTAL REPORT'IME FOR SUBMISSION OF ~iVIEWS ON ANTITRUST MATTER Niagara Mohawk Power Corporation, 300, Erie Boulevard West, Sycracuse, New York 13202, pursuant to Section 103 of the Atomic Energy Act of 1954, as amended, has filed an application dated June 7, 1972, for authorization to construct and operate a single cycle, forced cir'culation, .boiling water nuclear reactor at its site, located in the .town of Scriba, Oswego County, New York.

The site consists of 900 acres and is located 300 feet. due east of Nine Mile Point Unit 1 (Docket No. 50-220) on the southeast shoie of Lake. Ontario, approximately seven miles northeast o'f the City of Oswego.

The proposed nuclear facility, designated by the applicant as Nine Mile Point Unit 2,.is designed for initial operation at approximately 3300 megawatts 4

(thermal) with a net electrical output of appr'oximately 1100 megawatts.

Any person who wishes to have his views on the antitrust aspects of the application presented to the Attorney General for consideration, shall submit such views to the Commission within sixty (60) days after July 14, 1972.

A copy of the application is available for public inspection at the Commission's Public Document Room, 1717 H Street, N. W., Washington, D. C.

20545, and at the Oswego City Library, 120 E. Second Street, Oswego, New York 13126.

Niagara Mohawk Power Corporation has also filed, pursuant to the National Environmental Act of 1969 and the regulations of the Commission in Appendix D to 10 CFR Part 50, a report entitled> "Applicant's Environmental Report - Construction Permit Stage," dated June, 1972. The report has been made available for public inspection at the aforementioned locations. The report, which discusses environmental considerations related to the proposed construction of Nine Mile Point Unit 2, is also being made available at the New York State Office of Planning Services, 488 Broadway, Albany, New York 12207, and at the Central New York Regional Planning and Development Board, 321 East Water Street, Syracuse, New York 13202.

After the repox't has been analyzed by the Commission's Dix'ector of Regulation or his designee, a draft environmental statement related to the proposed action will be prepared by the Commission. Upon. preparation of the draft environmental statement, the Commission will, among other things, cause to be published in the FEDERAL REGISTER a summax'y notice of availability of the dxaft statement. The summary notice will request comments from Federal agencies, State and local officials, and interested persons on the proposed ac'tion and on the draft statement. The summary notice will also contain a statement to the effect that comments will be made available when received.
