DONALD C. COOK NUCLEAR PLANT, UNITS 1 AND 2-NUCLEAR REGULATORY COMMISSION STAFF REVIEW OF REVISION TO REGULA TORY COMMITMENTS ASSOCIATED WITH APPLICATION FOR RENEWED OPERATING LICENSE (TAC NOS. MF1308 AND MF1309)

Dear Mr. Weber:

By letter dated March 1, 2013 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML 13073A 11 0), Indiana Michigan Power Company (I&M), the licensee for Donald C. Cook Nuclear Plant (CNP), Units 1 and 2 submitted information and notified the U.S. Nuclear Regulatory Commission (NRC) of revisions to two commitments made in support of its license renewal application for the CNP units. The two commitments were evaluated in NUREG-1831, "Safety Evaluation Report Related to the License Renewal of the Donald C. Cook Nuclear Plant, Units 1 and 2" (ADAMS Accession No. ML052230442), which supported the CNP license renewal. The Renewed Facility Operating Licenses were issued on August 30, 2005 (ADAMS Accession No. ML052340339). By letter dated August 22, 2013 (ADAMS Accession No. ML 13240A129), I&M submitted a response to the NRC staff's request for additional information. The first commitment, identified as "Commitment 1" in I&M's March 1, 2013, letter, concerns enhancements to the Preventive Maintenance Program, including the management of the aging effects for the security diesel engine elastomer flex hoses or tubing. I&M's original commitment for inclusion of the security diesel generator room is provided in Commitment No. 16 in Appendix A of NUREG-1831. The licensee revised this commitment to remove the security diesel engine elastomer flex hoses or tubing from the scope of the program. The second commitment, identified as "Commitment 2" in I&M's March 1, 2013, letter, concerns enhancements to the Structures Monitoring Program for various structures, systems, and components, including the security diesel generator room. I&M's original commitment for inclusion of the security diesel generator room is provided in Commitment No. 23 in Appendix A of NUREG-1831. The licensee revised this commitment to remove the security diesel generator room from the scope of the program. In its March 1, 2013, letter, the licensee stated that they were making both of these commitment changes because " ... the security diesel generator engine does not meet the seeping requirements specified in 10 CFR 54.4, because the security diesel generator does not perform L. Weber a safety function and is not credited for outside lighting for either the Appendix R or National Fire Protection Association 805 Fire Protection Programs." The NRC staff reviewed the above revised commitments as described by the licensee and reviewed the commitments in their original form as evaluated in the safety evaluation report (NUREG-1831) supporting issuance of the Renewed Facility Operating Licenses. The NRC staff has determined that the revised commitments do not have any impact on the finding of acceptability in NUREG-1831 of I&M's aging management program for extended operation of the CNP units. Accordingly, the NRC staff acknowledges the changed commitments but takes no action to revise NUREG-1831 or the Renewed Facility Operating Licenses.
