FORT CALHOUN STATION, UNIT 1 - WITHDRAWAL OF AN AMENDMENT REQUEST (TAC NO. MC3586)

Dear Mr. Ridenoure:

By letter to the Nuclear Regulatory Commission (NRC) dated May 14, 2004, Omaha Public Power District (OPPD) applied for an amendment to the Fort Calhoun Station, Unit No. 1 (FCS),

Facility Operating License No. DPR-40. The proposed change would have provided a

risk-informed alternative to the existing restoration period for the High-Pressure Safety Injection (HPSI) System.

The FCS application of the risk informed change integrates Westinghouse Owner's Group (WOG) recommendations identified in WCAP-15773, "Joint Application Report for the

Implementation of a Risk Management Technical Specification for the High Pressure Safety

Injection (HPSI) System." The NRC staff review of this topical is ongoing and the NRC staff has

determined that a revised license amendment request needs to be submitted. As such, OPPD

by letter dated August 25, 2006, has requested to withdraw the May 14, 2004, license

amendment request. OPPD expects to resubm it a revised license amendment request during the first quarter of 2007.

The Commission has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication.

proposed amendment to Facility Operating License No. DPR-40 for the Fort Calhoun Station, Unit No. 1 (FCS), located in Washington County, Nebraska.

The proposed amendment would have revised the Technical Specifications Section 2.3(2)b, "Modification of Minimum Requirements." Specifically, the proposed change

would have provided a risk-informed alternative to the existing restoration period for the High-Pressure Safety Injection System.

The Commission had previously issued a Notice of Consideration of Issuance of Amendment published in the FEDERAL REGISTER on July 6, 2004 (69 FR 40677). However, by letter dated August 25, 2006, the licensee withdrew the proposed change.
