Non Acceptance of License Amendment Request Relating to TSTF-490-A Wendi, as we spoke on the phone:

By letter dated November 6, 2008, (Agencywide Documents Access and Management System (ADAMS) Accession Number ML083120122), AmerGen Energy Company, LLC (AmerGen) submitted a license amendment request for Three Mile Island Nuclear Station, Unit 1 (TMI-1). The proposed amendment would replace the current TMI-1 technical specification (TS) limit on Reactor Coolant System (RCS) gross specific activity with a new limit on RCS noble gas specific activity. The noble gas specific activity limit would be based on a new dose equivalent Xe-133 definition that would replace the current EBar average disintegration energy definition. In addition, the current dose equivalent 1-131 definition would be revised to allow the use of additional thyroid dose conversion factors. The purpose of this email is to provide the draft results of the U.S. Nuclear Regulatory Commission (NRC) staff's acceptance review of this amendment request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

The NRC staff has reviewed your application and concluded that the following information is necessary to enable the staff to make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment.

The application dated November 6, 2008 refers to an NRC staff Safety Evaluation (SE), described as reference 1, dated September 27, 2006 (ADAMS ML062700612). This document is not publically available. Since the submittal states that the methodology described in this staff SE was used to develop the proposed changes, it is not clear how this was accomplished. The NRC acknowledges that reference to ADAMS Accession No. ML062700612 was contained in the notice of availability of model application for this technical specification improvement that was posted in the federal register (72 FR 12217).

In order to make the application complete, the NRC staff requests that AmerGen supplement the application to provide a corrected reference for the methodology used to develop this proposed technical specification change as well as a correct reference to the public version of the NRC's safety evaluation for this TSTF. This will enable the NRC staff to begin its detailed technical review. If the information responsive to the NRC staff's request is not received by December 18, 2008, the application will not be accepted for review pursuant to 10 CFR 2.101, and the NRC will cease its review activites associated with the application.

As we discussed on the phone, if I don't hear from you by tomorrow morning, December 4, 2008, regarding the need for a follow-up telephone call, I will conclude that you understand the information requested and I will send you an official letter documenting such.
