Dear Mr. Devik:

By letter dated May 13, 2021 (Agencywide Documents Access and Management System Accession No. ML21144A262) as supplemented on September 21, 2021 (ADAMS Accession No. ML21267A505) and March 31, 2022 (ADAMS Accession No. ML22102A304), EnergySolutions, LLC (ES) submitted a license application request (LAR) seeking U.S. Nuclear Regulatory Commission (NRC) review and approval of modification to License Condition 2.C.(2) for the Three Mile Island, Unit 2 (TMI-2) license in support of the TMI-Station ISFSI Only Physical Security Plan.

After reviewing your submittals and your proposed License Condition (LC) 2C2, the NRC has proposed a modification to the LC 2C2.

Please review the draft LC and provide comments within 10 calendar days. Your response will be evaluated with your May 1, 2022 submittals, as identified in your March 31, 2022 letter (ADAMS Accession No. ML22102A304)related to this proposed license amendment request.

Red lines are proposed changes to the TMI-2 proposed License Condition (LC) for the TMI-2 license:

LC 2C2:

(2) Physical Protection

The licensee utilizes site physical security, guard training and qualification, and safeguards contingency plans the TMI-Station Part 37 plans which to address requirements for the protection ofPart 37 and Section 10 CFR 73.67 material. These plans apply to both TMI-1 and TMI-2 and are maintained by the licensee for TMI-1.

These plans are implemented under TMI-1 license condition 2.C.(3) and shall apply to TMI-2with respect to TMI-2.
