On March 12, 2012, the U.S. Nuclear Regulatory Commission (NRC) issued Order EA-12-049, "Order Modifying Licenses with Regard to Requirements for Mitigation Strategies for Design-Basis External Events" (Agencywide Documents Access and Management System (ADAMS) Accession No. ML 12054A736). By letter dated February 28, 2013 (ADAMS Accession No. ML 13136A022), Arizona Public Service Company (APS) submitted its Overall Integrated Plan for Palo Verde Nuclear Generating Station (PVNGS), Units 1, 2, and 3 in response to Order EA-12-049. By letter dated June 20, 2013, the NRC sent a request for additional information to APS (ADAMS Accession No. ML 13161A259). By letter dated July 18, 2013, APS replied to the request for additional information (ADAMS Accession No. ML 13206A006). By letter dated August 28, 2013 (ADAMS Accession No. ML 13246A007), APS submitted a six-month update to the Overall Integrated Plan. Based on a review of APS' plan, including the six-month update dated August 28, 2013, and information obtained through the mitigation strategies audit process, 1 the NRC concludes that the licensee has provided sufficient information to determine that there is reasonable assurance that the plan, when properly implemented, will meet the requirements of Order EA-12-049 at PVNGS, Units 1, 2 and 3. This conclusion is based on the assumption that the licensee will implement the plan as described, including the satisfactory resolution of the open and confirmatory items detailed in the enclosed Interim Staff Evaluation and Audit Report. Document transmitted herewith contains sensitive unclassified information.
