Dear Mary,
I am writing in response to your October 14, 2010 email to Mr. Bill Dean, Region I Administrator, regarding the Groundwater Protection Initiative (GPI) at Pilgrim Nuclear Power Station. As discussed during our phone conversation on October 29, Mr. Dean forwarded me your email for follow-up and resolution. Your email stated that NRC Integrated Inspection Report 05000293/2010004, which documented our review of the GPI implementation at Pilgrim, failed to provide meaningful information or indication that actual progress of substance is being made.
You stated that the only way we will ever know if groundwater flow is understood is to have a thorough groundwater study performed and made fully public. You requested that NRC provide assurance that we are willing to put public safety on the front burner.
As always, the NRC is dedicated to protecting public health and safety and the environment.
Regarding the particular concerns expressed in your email, I am aware of a 10 CFR 2.206 petition that you submitted to Bill Borchardt, NRC Executive Director of Operations, on August 13, 2010. The 2.206 petition requests that NRC require Entergy to perform an updated hydrogeologic assessment at Pilgrim, and that the analysis be made available to the general public. Because the points raised in your October 14 email are duplicative of those raised in your 2.206 petition, in order to not interfere with the 10 CFR 2.206 process, I do not plan any further follow-up to your email. If you feel that your email contained different information than what was contained in the 2.206 petition, or if there is other information you may want regarding this subject, please let me know.
Regarding the status of your 2.206 petition, my understanding is that the petition review board (PRB) made an initial recommendation to accept the petition for review. You were informed of the initial recommendation and submitted supplemental information for the board to consider.
The PRB will meet shortly to consider the supplemental information and determine if your request meets the criteria for review. You should receive notification of the PRBs final recommendation within the next several weeks.
