Retraction of License Amendment Request (LAR) 10-06 The Omaha Public Power District (OPPD) hereby withdraws the Reference 3 LAR, which proposed to establish the ultimate heat sink (UHS) limiting condition for operation (LCO) and add UHS level and temperature surveillance requirements.
Reference 3 was submitted to address a noncited violation of 10 CFR 50.36(c)(2)(ii)(B) identified in Reference 2, which determined that LCO 2.16 of the Fort Calhoun Station (FCS) Technical Specifications (TS) is inadequate should the Missouri River exceed 1009 feet mean sea level (MSL). LAR 10-06 was developed and submitted several months before it was known that Missouri River flooding would impact FCS in the summer of 2011. Although the river level at the site never exceeded 1009 feet MSL, and FCS remained safely shutdown during this period, OPPD is withdrawing the LAR to incorporate lessons learned from the flood. FCS remains shutdown to complete the 2011 refueling outage (RFO) and address items in the FCS Post-Flooding Recovery Plan. NRC concurrence that applicable commitments have been met is required before FCS can resume power operations.

Should FCS begin power operations before an amendment is implemented, OPPD will utilize existing guidance contained in Abnormal Operating Procedure (AOP)-1, "Acts of Nature," and shut the plant down if river level reaches 1004 feet MSL. Adm i nistrative controls such as this are an acceptable short-term corrective action as noted in NRC Administrative Letter 98-10, " Dispositioning of Technical Specifications that are Insufficient to Assure Plant Safety." A copy of this letter is being provided to the designated State of Nebraska Official.
