To Whom It May Concern:

The following is Constmetion Testing and Engineering's response to the noted violations during an

NRC Inspection conducted on December 11,1996.

The violations as noted on the attached Notice of Violation, Enclosure 1, consisted of the following:

A. 10 CFR 30.3 required, in part. that except for persons exempted, no person shall possess or

use byproduct material except as authorized by a specific or general license issued pursuant

to Title 10. Chapter 1, Code of Federal Regulations.

Contrary to the above, from January 2, to May 31,1996, Construction Testing &

Engineering, Inc. (CTE) possessed and used byproduct material in areas under exclusive

federal jurisdiction within an Agreement State without a valid NRC license and was not

exempted from the requirement for a license. (01013)

This is a Severity Level Ill violation (Supplement VI).

B. 10 CFR 30.9(a) required in part, that information provided to the commission by a licensee

be complete and accurate in all material respects.

Contrary to the above, the licensee provided information to the Commission that was not

! complete and accurate in all material respects. Specifically, on October 16,1997 and

December 12. 1997, CTE provided information that was incomplete regarding CTEN

activities insolving use of byproduct materials in areas of exclusive federal jurisdiction

without a valid NRC license. This information was material because it involved use of

RESPONSE TO VIOLATIONS I

Violation A _

f 1. Reason'for the Violation. l

l In a previous response prepared by CTE dated February 25, Enclosure 2, CTE fully admitted

'

to the violation. The infmetion occurred due to an administrative oversight of filing of NRC

l

Form 241. This oversight resulted in CTE being out of compliance from January through  ;

May 1996. . Once the oversight was detected CTE applied for, paid for, and obtained the i

! NRC Form 241.

l

2 13. Corrective Steos That Have Been Taken.

To prevent reoccurrence of this administrative oversight, CTE has applied for and obtained

a separate NRC General License (License #04-29106-01)

4. Required Period to Bring Firm into Comoliance, j

CTE obtained the General License on December 31,1996 for the 1997 year and therefoie

are currently in compliance. CTE will continue to renew the General NRC License until

. such time CTE no longer utilizes the radioactive sources on Federaljurisdiction properties.

Violation B {

1. Reason for Violation.

As stated in Enclosure 2. CTE fully admitted to unintentionally providing incomplete  !'

information regarding site visitations to Federal Jurisdiction properties during 1996 ca!endar

year. The infraction, as described in the February 25,1997 response, occurred due to the  !

vast information requiring review to compile the requested information, i.e., from all six of

CTE offices, and CTE's hurried attempt to provide the inspector with the information as

soon as possible. Again, as described in Enclosure 2, the infraction was unintentional.

l 213. Corrective Stens That Have Been Takeit.

I

To prevent any inaccurate ieporting to occur in the future, CTE has dedicated an individual

to be RSO and provided him with adequate time each day to accomplish the RSO duties.

The dedication of this individual occurred in January 1997.

4. Reauired Period to Brine Firm into Comnliance.

l CTE is currently in full reponing compliance with the NRC. Open communications between

l the NRC area inspector and CTE RSO are ongoing. CTE 'will contact the NRC area

inspector periodically to inform him of progress on our Radiation Safety Program.
