Attention:

Ms. Rosalie Foster

.

Business Administrator Thank you for your July 12 and August 24, 1993, letters in response to our June 21, 1993, Notice of Violation.

In your letter dated August 24, 1993, e

'

which we received on October 18, 1993, you stated that your corrective action in response to your radiographer leaving his radiographic device unattended would be to step all radiographic operations during any audit or interaction

'

with the radiographer by other than your employees. While we agree that you should never let outsiders interfere with the safe conduct of radiography, we must point out that we reserve the right pursuant to 10 CFR 30.52 to conduct inspections of your activities. You should allow us to observe radiography in progress. Our inspectors are trained not to interfere, however, they will inform your radiographer if they observe a significant safety concern.

Thank you for your cooperation in this matter.

Sincerely, 10003-Gregory P. Yuhas, Chief Radioactive Materials Safety Branch
