4735 Myrtle Avenue San Diego, California 92105 SUBJECT: NRC INSPECTION 150-00004/97-09 AND NOTICE OF VIOLATION

Dear Mr. May:

On October 28,1997, the NRC conducted an inspection of your activities in an area of exclusive federaljurisdiction aboard the U S.S. Constellation at the North Island Naval Air Station in Coronado, California. The findings of the inspection were initially discussed with Mr. Michael Moore of youe staff. A telephonic exit briefing was subsequently conducted with you on October 29,1997, Based on the results of the inspection, the NRC has determined that two violations of NRC requirements occurred. These violations are cited in the enclosed Notice of Violation (Notice)

,

and involved a failure to comply with certain U.S. Department of Transportation regulations involving shipping papers, and a failure to maintain 10 CFR Parts 19 and 34 at the temporary job site. The failure to maintain shipping papers is of concern because it is a repeat violation and indicates a need for further management attention to implementing corrective actions and to your training program for the transport of radioactive materials. Consequently, in your reply you should describe those actions taken or planned to improve the areas mentioned above.

You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. For your consideration and convenience, NRC Information Notice 96-28," SUGGESTED GUIDANCE RELATING TO DEVELOPMENT AND IMPLEMENTATICN OF CORRECTIVE ACTION,"is enclosed. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter, its enclosures, and your response will be placed in the NRC Public Document Room (PDR). To the extent possible, your response should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.
