Dear Mr. Flagor:

SUBi/ECT:

RESPONSE TO DEMAND FOR INFORMATION AND NOTICE OF PROPOSED IMPOSITION OF CIVIL PENALTIES (NRC Inspection Report 15000004/93-10)

Ne have reviewed your responses to the November 5, 1993, Demand 5 for Information (Demand) and Notice of Violation and Proposed Imposition of Civil Penalties (Notice).

The corrective actionsj; described in your responses will be verified during future inspections.

In your response to the Notice, you requested mitigation of the civil penalties based on an asserted inability to pay.

To demonstrate that you lack the financial resources to pay the civil penalties, you need to:

1) provide copies of Federal income tax returns for the years 1992, 1991, and 1990, for Richardson X-Ray, Ultrasonic Field Services Corp., and any other business entities with ownership common to Richardson; 2) provide copies of profit and loss statements for those same years for any entities covered by Item 1); and 3) sign the enclosures to this letter to permit the NRC to obtain a credit report.

If you desire NRC consideration of your financial condition before the NRC's next decision on this matter, you should submit the required information within thirty days from the date of this letter.

The information should be submitted directly to the Director, Office of Enforcement, U.

S.

Nuclear Regulatory Commission, Washington, D.

C.,

20555, with a copy to the Regional Administrator, NRC Region V, 1450 Maria Lane, Walnut Creek, California 94596.

Your response to Item E.

of the Demand was inadequate in that it did not include information describing procedures you will use to ensure that personnel are physically and mentally fit to carry out their responsibilities in accordance with NRC requirements (i.e., not so sick or tired that they would be unable to pay proper attention to safety requirements).

Therefore, you need to submit information describing these procedures within thirty days l
