NRC INSPECTION REPORT N0. 15000004/93-13
This refers to the special inspection cot. ducted by Mr. Kent M. Prendergast who
was accompanied by Mr. Eugene Power on September 29, 30, and October 25, 1993.
The inspection included a review of your activities in areas under federal
jurisdiction at Edwards Air Force Base in California. At the conclusion of
the inspection, the inspection findings were discussed with those members of
your staff identified in the enclosed report.
Areas examined during the inspection are identified in the report. Within
these areas, the inspection consisted of selective examinations of procedures

and representative records and interviews with personnel. The purpose of the
inspection was to determine whether your activities crMucted in areas under
federal jurisdiction were conducted safely and in accwdance with NRC
requirements.
.
Based on the results of this inspection, one apparent violation was identified
and is being considered for escalated enforcement action in accordance with
the " General Statement of Policy and Procedure for NRC Enforcement Actions"
'
(EnforcementPolicy),10CFRPart2,AppendixC. The apparent violation
involves the failure to have a valid NRC license when performing activities
using byproduct materials in areas under exclusive federal jurisdiction.
Accordingly, no Notice of Violation is presently being issued for these
inspection findings.
In addition, please be advised that your activities are
still under review by the Office of Investigations (01) and the number and
characterization of any apparent violations may change from that described in
the enclosed inspection report as a result of this review. An enforcement
conference to discuss any apparent violations will be scheduled following.
completion of the OI investigation.
No response regarding this apparent violation is required at this time. You
will be advised by separate correspondence of the results of further NRC
