: 1. Representative Sampling Samples  and                measurements        taken            as  required  herein shall be representative of the volume and nature of' ti.e monitored discharge and shall be.in accordance with the provisions of this permit.
: 2. Tett Procedures Test procedures for the analysis of pollutants shall conform to 40 CFR Part 136 and guidelines pubitshed pursuant to Section 304(h) of the FMPCA, U.S.C. Section 1314(h). If more than one method for analysis of a substance is approved for use, a method having a cetection Ilmit lower than the permit limit shall be used. If the detection limit of all. methods is higher than the* peratt listt the method having the lowest detection limit shall be used and a report of less than detection ilmit shall constitute compilance, however should EPA approve a method with a lower detection limit during the term of this permit the permittee shall use the newly approved method.
i              3.      Recording of Results l      .
For each measurement or sample taken pursuant to the requirements of this permit, the permittee shall record the following information:

Transfer of Permit                                                          i This permit may not be transferred or the name of. the permittee changed without notice to the Director and subsequent modification or revocation and reissuance of the permit. In the case of a change in name, ownership or control of the permittee's premises only, a request for' permit modification in a format acceptable to the Director is required at least 30 days prior to the change. In the          -
case of a change in name, ownership or control of the pecte's              4 premises accompanied by a change or proposed change in effluent            1 characteristics, a complete permit application is required to be            ,
submitted to the Director at least 180 days prior to the change.            !
Whenever the Director is notified of a change in name, ownership or control, he ?.4y require the submission of a new permit application.
: 10. Duty to Reapply
: a.      If the permittee intends to continue to discharge beyond the expiration date of this permit, the permittee shall file a complete permit application for reissuance of this permit at least 180 days prior to its expiration.                              '
: b.      Failure of the permittet to apply for reissuance at least 180 days prior to permit expiration will void the automatic continuation of the expiring permit          provided  by  ADEM  i Administrative Code Rule 335-6-6 .06.

            -,-        m1tER CONDmONS A. 1)  The permittee shall contact the Department within 24 hours of detecting a reponable spill, as defined under 40 CFR Pan 112, SPCC Regulations, or 40 CFR Part 117, Hazardous Substances Regulations.
: 2)    In the event that waste streams from various sources are combined for treatmm or discharge, the quantity of each pollutant propeny attributable tc e. art controlled waste source shall not exceed the specified limitation fu that waste source. : 3)    There shall be no discharge of polphlorinated biphenyl compounds such as those commonly used for transformer fluid.
: 4)    In addition to the requirements of Part I.B.5.A., the permittee shall submit with the quarterly monitoring reports, a tabulated summary of all permit limitation                  ,
violations. This submittal shall be in a form acceptable to the Director.                      !
: 5)    There shall be no discharge of floating solids or visible foam in other than trace              }
amounts from any surface water discharge a110wed by this permit. The permittee                  ;
                            . hall report all visible discharges or observations of floating materials, or oil sheens on the receiving stream, to the Depanment within 24 hours, or the next working day, whichever is sooner. Field data sheets shall have appropriate                      ,
spaces to record observations.                                                                  ;
: 6)  The xrmittee shall not store soil or other similar erodible materials in a manner in wilch runoff is uncontrolled, or conduct construction activities in a manner which produces uncontrolled runoff unless such runoff and practices have been specifically sprioved by the Department. ' Uncontrolled' shall mean, without                    l sedimentation b . sins or other controls approved by the Depanment. This permit may be modified to include limitations for the discharge from such facilities when installed.
: 7)    Discharge of any product registered under the Federal Insecticide, Fungicide, and Rodenticide Act to any waste stream which may ultimately be released to waters of the state is prohibited unless specifically authorized elsewhere in this permit. This requirement is not applicable to , products used for lawn and agricultural purposes. The discharge of chlorine is authorized in Pan I of this permit.
: 8)  The discharge of any hazardo:ss wastes to any waste stream which ultimately discharges to any receiving stream is prohibited, unless specifically authorized elsewhere in the permit.
: 9)  Copies of all routine radiological liquid effluent and water quality monitoring reports submitted to the NRC shall be made available upon the request of the State Director or his d esignee.

otherwise by the Director. Additionally, notification and retesting shall be                              5 required at the time of any future retreatment of the tower.
B.        The wrmittee shall not discharge chemical metal cleaning wastes as defined at 40 CFR                                            ,
423.1(c), to any surface impoundment unless one of the following conditions is met-
* i                                1.                  The permittee treats the wastes, prior to discharge to an earthen surface impoundment, to a level consistent with the limitations contained within this                              ,
permit for metal cleaning wastes, and maintains the pH within the surface                                  !
unpoundment at above 6.0 standard units; or                                                                i
: 2.                    The surface impoundment receiving the untreated wastes is constructed of a nonearthen material which is approved by the Department as being sufficiently                              ;
impermeable; or
: 3.                    The permittee submits, within 180 days following the effective date of this                                '
* rmit, a proposed plan to monitor the groundwater around the surface
:mpoundment, and implements said program within 120 days after Department approval. Such, plan shall provide for monitoring of the uppermost aquiter under the surface unpoundments, or for monitoring the leachate from the                                          ,
impoundment, such as with an underdrain system. Groundwater monitoring                                    !
requirements for the impoundment, after approval by the Department, shall                                  i become pan of this permit. Should monitoring results reveal that contamination is occurring, or has occurred, the permittee shall be required to terminate use of                        i the impoundment, and possibly clean up contaminated groundwater; or
: 4.                    The permittee provides attemate treatment as approved by the Department.
In all cases where EPA Guidelines apply to the discharges discussed above, a best professional judgement has been made that best conventional treatment (BCT)is equal to best practical treatment (BIT).

: 2. The above biomonitoring tests shall begin 90 days after the effective date of this permit,                                                l and be performed once per six (6) months through the expiration date of this permit.                                                      1 Biomomtoring test resu ts obtained during each period shall be summarized on the                                                          !
appropriate repon form approved by the Depanment, and submitted no later than 28                                                          +
days following the period. Samples collected for biomonitoring tests shall be collected                                                  ;
during periods of cooling tower blowdown. After completion of two (2) years of conductmg blomonitoring and all tests pass the criteria, then the testing frequency shall                                                !
b reduced to once per year.                                                                                                                ;
: 3. A minimum of three (3) 24 hour composite samples shall be obtained for use in each of                                                    I the above biomonitoring tests. Holciing time for each composite sample shall not exceed                                                  i 72 hours. (The samples shall be diluted using an appropriate control water, to the Instream Waste Concentration (IWC) of 9% DSN001 effluent for each test.) An appropriate control water shall be selected by the permittee but must be approved by the Department prior to use in the above tests.
: 4. For effluent toxicity tests to be acceptable control survival shall be at least 80% and other requirements set fonh in the EPA test method shall be met. In the event that any of these requirements are not met the results shall not be reponed and the test shall be rerun except in the case where test results indicate no significant difference between the control ancl effluent as outlined in item 5. below.                                                                                      .

: 5. Should results of any test required i.oove indicate there is a statistically significant difference at the 95% confidence level between the control and the DSN001 effluent for                                                    i either the fathead minnow survival and growth test or the Ceriodaphnia survival and                                                      ,
reproduction test, the permittee shall perfonn that test at an accelerated frequency in accordance with the following requirements:
: a.          These additional biomonitoring tests shall begin 30 days after the DSN001 effluent has been found to be potentially toxic, and shall be perfc.rmed one (1) per week for two (2) weeks. Biomonitoring test results obtair.e d during each month shall be summarized on the appropriate repon form approved by the Department, and submitted no later than 28 days after the mor.th in which the tests were performed.                                                                                                        .
: b.          After the test period is complete and all test data is received, the Department will review the data to determine if the DSN001 effluent is chronically toxic. If more than 20% of the test organisms die in the control water during the test, the                                            -
results shall not be reponed, and the test shall be rerun.

receives notice that the DSN001 effluent is considered chronically toxic.                                                    i Following review of Part One of the TRE a schedule for submittal of Part Two                                                  .
will be established by the Depanment. Im >lementation of any corrective action                                                i
                .          required by the Part Two submittal shall x completed in accordance with the                                                  '

1. Representative Sampling Samples and measurements taken as required herein shall be representative of the volume and nature of' ti.e monitored discharge and shall be.in accordance with the provisions of this permit.
2. Tett Procedures Test procedures for the analysis of pollutants shall conform to 40 CFR Part 136 and guidelines pubitshed pursuant to Section 304(h) of the FMPCA, U.S.C. Section 1314(h). If more than one method for analysis of a substance is approved for use, a method having a cetection Ilmit lower than the permit limit shall be used. If the detection limit of all. methods is higher than the* peratt listt the method having the lowest detection limit shall be used and a report of less than detection ilmit shall constitute compilance, however should EPA approve a method with a lower detection limit during the term of this permit the permittee shall use the newly approved method.

For each measurement or sample taken pursuant to the requirements of this permit, the permittee shall record the following information:

d. The name(s) of the person (s) who performed the analyses;

a. The permittee shall retain records of all monitoring information, including all calibration and maintenance records and all original strip chart recordings for continuous monitoring instrumentation, copies of all reports required by' the permt t, and records of all data used to complete the above reports or the application for this l

2. Change in Discharge -

quantity of a discharged pollutant or that could result in an addltional discharge point. This requirement applies to pollutants that are or that are not subject to discharge limitations ir. this permit. No new or increased discharge may begin untti the Director has authorized it by issuance of a  :

permit modification or a reissued permit,

b. The permittee sha11' notify the Director as soon as they know i or have reason to believe: t

4. Compilance with Water Quality Standards and Other Provisions
a. On the basis of the permittee's application, plans, or other available information, the Department has determined that compilance with the terms and conditions of this permit will .i assure compliance with the appilcable water quality standards,

Compliance with permit terms and conditions notwithstanding, if the permittee's discharge (s) from point sources identified ,

in Part I., A. of this permit cause or contribute to a condition in contravention of State water quality standards, '

the Department may require abatement action to be taken by i the permittee in emergency situations or modify the permit  !

pursuant to the Department's rules and regulations, or both. -

c. If the Department determines, on the basis of a notice '

provided pursuant to Part II., B., 2. of this permit or any -

' investigation, inspection or sampling, that a modification of ,

this permit is necessary to assure maintenance of water o quality standards or compliance with other provisions of the State or FHPCA, the Department may require such modification '

and, in cases of emergency, the Olrector may prohibit the act until the per.att has been modified.

5. Right of Entry and,. spection The permittee shall allow the Director, or an authorized representative, upon the presentation of credentials and other documents as may be required by law to:

6. Updating Information
a. The permittee shall inform the Director of any change in the ,

permittee's mailing address or telephone number or in the permittee's designation of a facility contact or office (s) l having the authority and responsibility to prevent and abate violations of the AWPCA, the Department's rules and regulattens and the terms and conditions of this permit, in  ;

writing, no later than ten (10) days after such change. Upon request of the Director or his designee, the permittee shall i furnish the Director with an update of an information i provided in the permit application,

b. If the permittee becomes aware that it failed to submit any ,

relevant facts in a permit application, or submitted incorrect information in a permit application or in any report to the Director, it shall promptly submit such facts or information with a written explanation for the mistake and/or omission.

7. Permit Modification, Suspension, Termination and Revocation
a. This permit may be modtfled. st;spended, terminated or revoked and reissued, in whole or in part, during its term for cause, '

inclubing but not Ilmited to, the following:

(1) Violatice of any term or condition of this permit; (2) ' Obtaining this permit by atstepresentation or fatlure to disclose fully all relevant facts;

!- (3) Materially false or inaccurate statements or information in the permit application or the permit; ,

(4) A chinge in any condition that requires either a temporary or permanent reduction or elimination of the permitted discharge;

8. Duty to Provide Information

9. Transfer of Permit i This permit may not be transferred or the name of. the permittee changed without notice to the Director and subsequent modification or revocation and reissuance of the permit. In the case of a change in name, ownership or control of the permittee's premises only, a request for' permit modification in a format acceptable to the Director is required at least 30 days prior to the change. In the -

case of a change in name, ownership or control of the pecte's 4 premises accompanied by a change or proposed change in effluent 1 characteristics, a complete permit application is required to be ,

submitted to the Director at least 180 days prior to the change.  !

Whenever the Director is notified of a change in name, ownership or control, he ?.4y require the submission of a new permit application.

10. Duty to Reapply
a. If the permittee intends to continue to discharge beyond the expiration date of this permit, the permittee shall file a complete permit application for reissuance of this permit at least 180 days prior to its expiration. '
b. Failure of the permittet to apply for reissuance at least 180 days prior to permit expiration will void the automatic continuation of the expiring permit provided by ADEM i Administrative Code Rule 335-6-6 .06.

11. Groundwater '

1. Tampering Any person who falsifies, tampers with, or kr.owi ngly renders 1 inaccurate any monitoring device or method required to be maintained or performed under the permit shall, upon conviction, be subject to penalties as provided by the AWPCA.

enforcement actions under the ANPCA.

.(3) An action for injunctive relief; or (4) An action for penalties. '

c. Any order issued by the Department pursuant to the AHPCA requiring compilance with the ANPCA, its implementing rules, or an NPDES Permit shall specify a reasonable time within

.which noncompliance must cease. In appropriate cases a .

reasonable time may be lamediately. Reasonableness shall be determined based upon the severity of the violation and the comple*xity and availability of the measures necessary to correct this violation,

d. If the. permittee is not in compliance with the conditions of an expiring or expired permit the Director may choose to do  ;

8. OIL AND HAZARDOUS SUBSTANCE LIABILITY l t

Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from any responsibilities, i liabilities or penalties to which the permittee is or may be subject under Section 311 of the FWPCA, 33 U.S.C. Section 1321.

C. PROPERTY AND OTHER kIGHTS  ;

This permit does not convey any property rights in either real or ,

personal property, or.any exclusive privileges, nor does it authorize any .

Injury to persons or property or invasion or other private rights, or any- -

17. Waters - means "[4311 waters of any . river, str'eam, watercourse,.

pond, lake, coastal, ground or surface water, wholly or partially within the State, natural or artificial. This does not include waters which are entirely confined and retained completely upon the l property of a single individual, partnership or corporation unless  !

such waters are used in interstate commerce." Code of Alabama 1975, j Section 22-22-1(b)(2). Waters " include all navigable waters" as ,

defined in Section 502(7) of the FMPCA, 22 U.S.C. Section 1362(7),

which are within the State of Alabama.

18. Week - means the period beginning at twelve midnight Saturday and ending at twelve midnight the following Saturday.

F. SEVERABILITY The provisions of this permit are severable, and if any provision of this permit or the appItcation of any provision of this permit to any circumstance is held invalid, the app!! cation of such provision to other circumstances, and the remainder of. this permit, shall not be affected thereby '

2) In the event that waste streams from various sources are combined for treatmm or discharge, the quantity of each pollutant propeny attributable tc e. art controlled waste source shall not exceed the specified limitation fu that waste source. The permittee shall not combine various sources for treatment or  !

, discharge without prior approval by the Department.

3) There shall be no discharge of polphlorinated biphenyl compounds such as those commonly used for transformer fluid.
4) In addition to the requirements of Part I.B.5.A., the permittee shall submit with the quarterly monitoring reports, a tabulated summary of all permit limitation ,

violations. This submittal shall be in a form acceptable to the Director.  !

5) There shall be no discharge of floating solids or visible foam in other than trace }

amounts from any surface water discharge a110wed by this permit. The permittee  ;

. hall report all visible discharges or observations of floating materials, or oil sheens on the receiving stream, to the Depanment within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />, or the next working day, whichever is sooner. Field data sheets shall have appropriate ,

spaces to record observations.  ;

6) The xrmittee shall not store soil or other similar erodible materials in a manner in wilch runoff is uncontrolled, or conduct construction activities in a manner which produces uncontrolled runoff unless such runoff and practices have been specifically sprioved by the Department. ' Uncontrolled' shall mean, without l sedimentation b . sins or other controls approved by the Depanment. This permit may be modified to include limitations for the discharge from such facilities when installed.
7) Discharge of any product registered under the Federal Insecticide, Fungicide, and Rodenticide Act to any waste stream which may ultimately be released to waters of the state is prohibited unless specifically authorized elsewhere in this permit. This requirement is not applicable to , products used for lawn and agricultural purposes. The discharge of chlorine is authorized in Pan I of this permit.
8) The discharge of any hazardo:ss wastes to any waste stream which ultimately discharges to any receiving stream is prohibited, unless specifically authorized elsewhere in the permit.
9) Copies of all routine radiological liquid effluent and water quality monitoring reports submitted to the NRC shall be made available upon the request of the State Director or his d esignee.

blowdown and in DSN001. During the first we rk of cooling operation following a reapplication of wood ?reservatives, the permittee shall begin the toxicity  ;

testing program requir?.d n Part IV, Page 20 of this permit, unless directed '

otherwise by the Director. Additionally, notification and retesting shall be 5 required at the time of any future retreatment of the tower.

B. The wrmittee shall not discharge chemical metal cleaning wastes as defined at 40 CFR ,

423.1(c), to any surface impoundment unless one of the following conditions is met-

  • i 1. The permittee treats the wastes, prior to discharge to an earthen surface impoundment, to a level consistent with the limitations contained within this ,

permit for metal cleaning wastes, and maintains the pH within the surface  !

unpoundment at above 6.0 standard units; or i

2. The surface impoundment receiving the untreated wastes is constructed of a nonearthen material which is approved by the Department as being sufficiently  ;

impermeable; or

3. The permittee submits, within 180 days following the effective date of this '
  • rmit, a proposed plan to monitor the groundwater around the surface
mpoundment, and implements said program within 120 days after Department approval. Such, plan shall provide for monitoring of the uppermost aquiter under the surface unpoundments, or for monitoring the leachate from the ,

impoundment, such as with an underdrain system. Groundwater monitoring  !

requirements for the impoundment, after approval by the Department, shall i become pan of this permit. Should monitoring results reveal that contamination is occurring, or has occurred, the permittee shall be required to terminate use of i the impoundment, and possibly clean up contaminated groundwater; or

4. The permittee provides attemate treatment as approved by the Department.

In all cases where EPA Guidelines apply to the discharges discussed above, a best professional judgement has been made that best conventional treatment (BCT)is equal to best practical treatment (BIT).

C. ' EFFLUENT 1DXK'ITY LIMITATIONS AND BIOMONITORING REQUIREMENTS i

1. The permittee shall perform shon. term chronic screening tests on DSN001 effluent la I accordance with the cunent edition of the " EPA Short Tenn Methods for Estimating the  !

Chronic Toxicity of Effluents and Receiving Waters to Freshwater Organisms."

2. The above biomonitoring tests shall begin 90 days after the effective date of this permit, l and be performed once per six (6) months through the expiration date of this permit. 1 Biomomtoring test resu ts obtained during each period shall be summarized on the  !

appropriate repon form approved by the Depanment, and submitted no later than 28 +

days following the period. Samples collected for biomonitoring tests shall be collected  ;

during periods of cooling tower blowdown. After completion of two (2) years of conductmg blomonitoring and all tests pass the criteria, then the testing frequency shall  !

b reduced to once per year.  ;

3. A minimum of three (3) 24 hour2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> composite samples shall be obtained for use in each of I the above biomonitoring tests. Holciing time for each composite sample shall not exceed i 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br />. (The samples shall be diluted using an appropriate control water, to the Instream Waste Concentration (IWC) of 9% DSN001 effluent for each test.) An appropriate control water shall be selected by the permittee but must be approved by the Department prior to use in the above tests.
4. For effluent toxicity tests to be acceptable control survival shall be at least 80% and other requirements set fonh in the EPA test method shall be met. In the event that any of these requirements are not met the results shall not be reponed and the test shall be rerun except in the case where test results indicate no significant difference between the control ancl effluent as outlined in item 5. below. .

5. Should results of any test required i.oove indicate there is a statistically significant difference at the 95% confidence level between the control and the DSN001 effluent for i either the fathead minnow survival and growth test or the Ceriodaphnia survival and ,

reproduction test, the permittee shall perfonn that test at an accelerated frequency in accordance with the following requirements:

a. These additional biomonitoring tests shall begin 30 days after the DSN001 effluent has been found to be potentially toxic, and shall be perfc.rmed one (1) per week for two (2) weeks. Biomonitoring test results obtair.e d during each month shall be summarized on the appropriate repon form approved by the Department, and submitted no later than 28 days after the mor.th in which the tests were performed. .
b. After the test period is complete and all test data is received, the Department will review the data to determine if the DSN001 effluent is chronically toxic. If more than 20% of the test organisms die in the control water during the test, the -

results shall not be reponed, and the test shall be rerun.

b. A TRE is defined as a plan to determine what actions will be required for I complying with effluent toxicity limitations. The TRE plan is completed in two i pans; 1) Jetermination of which control options are to be evaluated, and 2)

Evaluation of these control options to determine which will be optimum for

  • attaining compliance. The second phase of the TRE shall include a schedule for -

implementing the required actions, r
