Letter to the Nuclear Regulatory Commission from Henry B. Barron (Duke) dated November 30, 2006, 'Tornado/HELB Mitigation Strategies and Regulatory Commitments" The purpose of this letter is to adjust the due date for commitment 7T in the aforementioned reference and to inform the Staff that the due date for commitment 5T will likely need a similar adjustment.

Duke committed to notify the Staff of significant changes to the scope and/or completion dates of any tornado and high energy line break commitments, as described in Attachments 1 and 3 respectively, of the referenced letter.Commitment 7T addressed the July 2007 submittal of a License Amendment Request (LAR) that would establish a new tornado licensing basis and mitigation strategy for Oconee Nuclear Station (ONS). The adjustment in the LAR submittal schedule is necessitated by intervening circumstances that could not have been reasonably anticipated when the commitment was made in November 2006.First, in March 2007, the NRC published Revision 1 to Regulatory Guide (RG)1.76, "Design-Basis Tornado and Tornado Missiles for Nuclear Power Plants," which Duke plans to incorporate into its tornado licensing basis. Second, Duke has initiated a study to more accurately depict the anticipated tornado characteristics (such as frequency and size) for the region surrounding ONS.Third, an element in the new tornado mitigation strategy is the proposed use of Fiber Reinforced Polymer (FRP) to strengthen selected existing masonry walls against tornado effects. The approval of the associated June 2006 LAR has been delayed beyond its anticipated approval date.www. duke-energy.

com Nuclear Regulatory Commission Revision to Tornado/HELB Mitigation Strategies and Regulatory Commitments Page 2 Based on current expectations for completion of revisions to the tornado mitigation strategy incorporating the above referenced information, the submittal of the tornado LAR addressed in Commitment 7T is anticipated in January 2008.In addition, the intervening circumstances described above will likely result in a change in the scope and implementation of the modifications to the existing West Penetration Rooms and Cask Decontamination Tank Rooms masonry walls (commitment 5T). Additional information regarding the scope and implementation schedule for this activity will be provided in separate correspondence.
