SECY 3 - IMPLEMENTATION OF CATEGORY B REQUIREMENTS FOR THE CONTINUITY OF GOVERNMENT PROGRAM This is to advise you that the Commission (with Chairman Palladino and Commissioners Bernthal and Zech agreeing) has approved your proposed implementation of the agency's " Category B" responsibil-ities in the Continuity of Government program for FY 1985.

Commis-sioners Asselstine and Roberts disapproved noting that they believe, the NRC should have a Category C designation.

SUBJECT:

STAFF REQUIREMENTS--SECY-85 NRC SUNSHINE ACT REGULATIONS The Commission has voted 5-0 to approve for publication for a 30 day public comment period, the proposed rule change to Part 9, Subpart C - Covernment in the Sunshine Act Regulations.

The essence of the rule change is to conform the definition of

" meeting" therein to the decision of the Supreme Court in Federal Communications Commission v. ITT World Communications -!
