SUBJECT:

SECY-85-lli -- PROPOSED CIVIL PENALTY FOR SEQUOYAH-1 This is to advise you that the Commission (with Chairman Palladino and Commissioners Asselstine, Bernthal, and Zech agreeing) has disapproved your proposed civil penalty.

The Commission has agreed that a civil penalty of $150,000 should be imposed based on three Category III violations at $50,000 i each.

This should then be mitigated by 25% for a total fine of $112,500.

Cormissioner Roberts disagrees with the Commission majority and agreed with your original proposal.

Comments of individual Commissioners have been provided to you on their vote sheets for this action.
