SECY-85-5-NOTICE OF APPLICATI N AND JURISDICTION WITH RESPECT TO PART 70 MATERIALS LICENSES This is to advise you that the Commission (with all Commis- A sioners agreeing) has approved your recommendation to allow Licensing Borrds g to continue to assert jurisdiction over application tor Part 70 licenses until the Commission has established procedures to govern informal adjudication of materials licenses cases.
The Commission (with Commissioners Roberte, Bernthal, and Zech approving) also agreed that OGC should provide the Commission with the proposed rule on procedures within 60 days. Commissioner Bernthal noted, however, that he would not object to a somewhat longer period of time if OGC believes it to be necessary.
