informed the Atomic Safety and Licensing Board (" Licensing Board") that the Board of Directors of Gulf States Utilities Company voted not to build Unit 2 of the River Bend Station.
Accordingly, pursuant to 10 C.F.R.          52.10 7 (a) , Gulf States Utilities Company requests that the Licensing Board issue an order authorizing the withdrawal, without prejudice, of the operating license application for Unit 2 in the captioned proceeding.O In  support  of    this  motion,  Gulf    States        Utilities Company submits to the Licensing Board its River Bend Unit 2

a copy of which is being submitted to the Director of the NRC Office of Nuclear Reactor Regulation.      Amendment 1 to the    River    Bend Station  Application,  to    reflect  the withdrawal of the application for Unit 2 is also being submitted to the Director.
As discussed more fully in the attached Report, Gulf States Utilities Company made a commitment to return dis-turbed site areas to an acceptable state under a program to be approved and supervised by the NRC Staff. On this basis, other Licensing Boards have granted the relief requested

Therefore, Gulf States Utilities is submitting the following information with regard to the cancellation of Unit 2:

  .                                                                                                                                                            l s'    INTRODUCTION In the early 1970's Gulf States Utilities Company (GSU) undertook a study of alternate energy sources and sites for meeting its projected power demands. The selection of the River Bend Site and a nuclear fueled generating station with cooling towers was made using the process described in Chapter 9 of the River Bend Station Environmental Report-Construction Permit Stage. This document was prcvided as part of GSU's construction permit application tendered in June 1973. The acquisition of the property for the 3342 acre site began in January 1970 and the final parcel was obtained in December 1974.                                      Issuance of a limited Work Authorization in September 1975 allowed GSU to begin
      " clearing and grading the plant site, excavation (and dewatering system) for reactor and other building foundations, installation of a railroad spur and new north access road, installation of water wells, installation of fire protection facilities, diversion of West Creek and erection of construction support facilities as follows: offices, warehouses, shops, roads, and construction power." The Construction Permit was issued March 25,=1977 allowing construction of the facility.                In the summer of 1977 GSU suspended construction of the station due to financial considerations. Construction of Unit I was resumed in the summer of 1979 but Unit 2 remained suspended.                                      In January 1984 GSU announced the cancellation of Unit 2.                                Unit 1'is scheduled for April 1985 fuel load and December 1985 commercial operation dates. As of ' April 30, 1984 Unit I was 87.3% complete.

s        included at the end of this report. This report also includes a discussion of the disposition of the Unit 2 devatering system, buildings, and equipment.
      ..c EXCAVATION RESTORATION The Unit 2 excavation bottom comprises approximately 11 acres bounded by excavation slopes to the north, west, and south and the Unit 1 slope to the east.. The area at grade +94 ft ms1 is approximately 16 acres.
The excavation was completed to an elevation of +20 ft mal and has been backfilled to an average of +66 ft mal.
The proposed restoration plan consists of backfilling the excavation to plant grade +94 ft asi using the indigenous material removed and stored onsite. The backfill will be compacted and sloped for drainage.
Topsoil will be applied and a vegetative cover provided. This work will be accomplished during the year following commercial operation.

[              COOLING TOWER RESTORATION Nine acres were cleared and graded at the northern portion of the site for the installation of four mechanical draft cooling towers for Unit
: 3. ' '  2. The area is flat and at about 104 ft asi, approximately 10 ft above normal yard grade.
Topsoil and seeding will be used to restore the area. No additional provisions for drainage is required.
Restoration of the Unit 2 cooling tower area will be done in conjunction with the overall site restoration after commercial operation as was stated earlier. Restoration of this area does not affect plant safety.
DISPOSITION OF DEWATERING WELLS Approximately 20 dewatering wells have been installed-in the Unit 2 area around the perimeter of the ercavation. .These wells will be plugged and abandoned in accordance with " Water Well Rules, Regulations, and Standards - State of Louisiana Department of Public Works." This work will be completed within the first year of commercial operation of Unit 1.

c oling tower #2 was provided in the excavation area.                This structure will be covered as the excavation is backfilled.
UNIT 2 EQUIPMENT STATUS Unit 2 equipment stored onsite includes: the Unit 2 reactor vessel which is housed in a storage facility located in the southwest corner of the plant at the intersection of West Creek and the River Access Road, the condenser tube modules which are stored in the primary spoil area located northwest of the juncture of Hwy 965 and the River Access Road, and the shroud and drier which are stored in the cable yard located south of the clarifier area. GSU intends to seek interested buyers for this equipment and dispose of it as soon as practicable. If buyers cannot be located, it will continue to be stored onsite. When these onsite land areas are cleared of Unit 2 equipment, they will be restored by topsoil and seeding in conjunction with the overall site restoration after commercial operation.

APPLICATION FOR OPERATING LICENSE On March 25, 1977, the U. S. Nuclear Regulatory Commission ("NRC") issued Construction Permit No. CPPR-145 to Gulf States Utilities Company ("GSU" or 1
      " Applicant") for the River Bend Station, Unit 1. On October 3, 1980, the NRC amended Construction Permit CPPR-145 to permit the acquisition of an ownership interest in Unit 1 of the River Bend Station by Cajun Electric                    -
Power Cooperative, Inc. (" Cajun"). In accordance with the Atomic Energy Act              -
of 1954, as amended, and the rules and regulations issued thereunder in Title 10, Code of Federal Regulation, the Applicant, on its own behalf and on behalf of Cajun, as their interests are hereinafter set forth, h'ereby makes                    ;

Description of Business and Organization of GSU and Cajun GSU Gulf States Utilities, a Texas Corporation, was incorporated in 1925 and is primarily in the business of generating, transmitting, and distributing electricity to 541,754 customers in Southeast Texas and South Central Louisiana. The service area extends 350 miles westward from Baton Rouge,          1 Louisiana, to a point about 60 miles east of Austin, Texas. The service area encompasses the northern suburbs of Houston and major cities such as Conroe, Huntsville, Port Arthur, Orange, and Beaumont, Texas; Lake Cilarles and Baton Rouge, Louisiana.

                ' Cajun Electric Power Cooperative, Inc., incorporated in the State of Louisiana, is organized and operated as a power supply cooperative owned by a federation of thirteen electrical distribution cooperatives serving rural Louisiana. Cajun is principally engaged in the business of generating electrical energy and providing wholesale energy to its member. cooperatives at numerous points throughout the state.

MOTION FOR WITHDRAWAL OF APPLICATION FOR UNIT 2 On January -6, 1984, Gulf States Utilities Company ,

informed the Atomic Safety and Licensing Board (" Licensing Board") that the Board of Directors of Gulf States Utilities Company voted not to build Unit 2 of the River Bend Station.

Accordingly, pursuant to 10 C.F.R. 52.10 7 (a) , Gulf States Utilities Company requests that the Licensing Board issue an order authorizing the withdrawal, without prejudice, of the operating license application for Unit 2 in the captioned proceeding.O In support of this motion, Gulf States Utilities Company submits to the Licensing Board its River Bend Unit 2

o Report on Termination of Construction Activities (" Report"),

a copy of which is being submitted to the Director of the NRC Office of Nuclear Reactor Regulation. Amendment 1 to the River Bend Station Application, to reflect the withdrawal of the application for Unit 2 is also being submitted to the Director.

As discussed more fully in the attached Report, Gulf States Utilities Company made a commitment to return dis-turbed site areas to an acceptable state under a program to be approved and supervised by the NRC Staff. On this basis, other Licensing Boards have granted the relief requested

. l s' INTRODUCTION In the early 1970's Gulf States Utilities Company (GSU) undertook a study of alternate energy sources and sites for meeting its projected power demands. The selection of the River Bend Site and a nuclear fueled generating station with cooling towers was made using the process described in Chapter 9 of the River Bend Station Environmental Report-Construction Permit Stage. This document was prcvided as part of GSU's construction permit application tendered in June 1973. The acquisition of the property for the 3342 acre site began in January 1970 and the final parcel was obtained in December 1974. Issuance of a limited Work Authorization in September 1975 allowed GSU to begin

" clearing and grading the plant site, excavation (and dewatering system) for reactor and other building foundations, installation of a railroad spur and new north access road, installation of water wells, installation of fire protection facilities, diversion of West Creek and erection of construction support facilities as follows: offices, warehouses, shops, roads, and construction power." The Construction Permit was issued March 25,=1977 allowing construction of the facility. In the summer of 1977 GSU suspended construction of the station due to financial considerations. Construction of Unit I was resumed in the summer of 1979 but Unit 2 remained suspended. In January 1984 GSU announced the cancellation of Unit 2. Unit 1'is scheduled for April 1985 fuel load and December 1985 commercial operation dates. As of ' April 30, 1984 Unit I was 87.3% complete.

..c EXCAVATION RESTORATION The Unit 2 excavation bottom comprises approximately 11 acres bounded by excavation slopes to the north, west, and south and the Unit 1 slope to the east.. The area at grade +94 ft ms1 is approximately 16 acres.

The excavation was completed to an elevation of +20 ft mal and has been backfilled to an average of +66 ft mal.

The proposed restoration plan consists of backfilling the excavation to plant grade +94 ft asi using the indigenous material removed and stored onsite. The backfill will be compacted and sloped for drainage.

Topsoil will be applied and a vegetative cover provided. This work will be accomplished during the year following commercial operation.

[ COOLING TOWER RESTORATION Nine acres were cleared and graded at the northern portion of the site for the installation of four mechanical draft cooling towers for Unit

3. ' ' 2. The area is flat and at about 104 ft asi, approximately 10 ft above normal yard grade.

Topsoil and seeding will be used to restore the area. No additional provisions for drainage is required.

Restoration of the Unit 2 cooling tower area will be done in conjunction with the overall site restoration after commercial operation as was stated earlier. Restoration of this area does not affect plant safety.

DISPOSITION OF DEWATERING WELLS Approximately 20 dewatering wells have been installed-in the Unit 2 area around the perimeter of the ercavation. .These wells will be plugged and abandoned in accordance with " Water Well Rules, Regulations, and Standards - State of Louisiana Department of Public Works." This work will be completed within the first year of commercial operation of Unit 1.

UNIT 2 EQUIPMENT STATUS Unit 2 equipment stored onsite includes: the Unit 2 reactor vessel which is housed in a storage facility located in the southwest corner of the plant at the intersection of West Creek and the River Access Road, the condenser tube modules which are stored in the primary spoil area located northwest of the juncture of Hwy 965 and the River Access Road, and the shroud and drier which are stored in the cable yard located south of the clarifier area. GSU intends to seek interested buyers for this equipment and dispose of it as soon as practicable. If buyers cannot be located, it will continue to be stored onsite. When these onsite land areas are cleared of Unit 2 equipment, they will be restored by topsoil and seeding in conjunction with the overall site restoration after commercial operation.

This application does not involve any restricted data or other classified information (defense information) and it is not expected that any will become involved. If it does, it will be appropriately segregated and safeguarded as required by law. GSU and Cajun agree that they will not permit any ind'ividual to have access to Restricted Data until the Civil Service Commission shall have made an investigation and report to the Nuclear Regulatory Commission on the character, associations, and loyalty of such individual, and the Nuclear Regulatory Commission shall have determined that permitting such person to have access to restricted data will not endanger the common defense and security.
