==Dear Administrative Judges:== | ==Dear Administrative Judges:==
On May 5, 2015, FPL provided a letter with its understanding of the schedules for certain related state administrative proceedings and best estimates of the timeframe for expected decisions. Since that time, a number of developments have occurred that may be of interest to the Board. First, the South Florida Water Management District issued an Emergency Order on May 19, 2015, which allows the withdrawal of water from the L-31 E canal during the pendency of the administrative challenge to the consumptive use permit, subject to certain conditions. Subsequently, the U.S. Army Corps of Engineers and Miami-Dade County issued wetland permits necessary to install pipe for the L-31 E withdrawals on May 22 and June 1, respectively. The L-31 E authorization only allows withdrawals if a certain level of water is available in the canal. To date, no water has been withdrawn from the L-31 E canal due to insufficient rainfall. Second, a joint motion for continuance of the scheduled hearing was filed yesterday by the parties in each of two relevant administrative hearings. These include the challenge to the modification of the Conditions of Certification for Turkey Point Units 3-5 to allow Upper Floridan Aquifer wells and the challenge to the Administrative Order that would require FPL to submit a Salinity Management Plan. In both cases, all parties agreed to a 12-week continuance

Docket Nos. 50-250-LA and 50-251-LA
Dear Administrative Judges:
Administrative Judges Gibson, Kennedy and Sager June 25, 2015 Page 2 of 2 to allow time and opportunity to attempt to resolve the issues in dispute. The Administrative Judge today granted the continuances in both cases. FPL will continue to inform the Board of significant developments in these cases.
