Dear Dr. Mallett:

This letter is to officially inform your office that the Planning Deficiency identified during the July 19,2006, full-scale exercise of the Missouri state and local radiological emergency response plans for the Cooper Nuclear Station has been corrected.

The Deficiency, concerning inadequate planning for the Pleasant View Skilled Nursing Facility and the Atchison County Jail in Rock Port, Missouri, was corrected with the submission of revised plans and procedures. These included revisions to the Atchison County Radiological Emergency Response Plan, the Missouri Nuclear Accident Plan and procedures for the Atchison County Jail and the Pleasant View Skilled Nursing Facility. These revisions were approved by this office on October 16,2006.

The July 19,2006, full-scale exercise evaluated the offsite radiological emergency response plans and preparedness for the State of Missouri and local jurisdictions, site-specific to the Cooper Nuclear Station. Based on the results of the full-scale exercise and the plan revisions noted above, the aforementioned plans are determined to be adequate to provide reasonable assurance that appropriate measures can be taken offsite to protect the health and safety of the public in the event of a radiological emergency at the site. Therefore, based on the above, the Title 44 CFR, Part 350 approval, granted on July 2,1984, will remain in effect.

Should you have any questions, please contact Audie Canida at 816-283-7074.

Sincerely, Ronald L. McCabe, Chief Radiological Emergency Preparedness Section cc: John Dixon, CNPPD Bill Maier, NRC IV Anthony McMurtray, NRC HQ Ronald M. Reynolds, SEMA Joe Bednar, NPPD
