ENTERGY'S RESPONSE IN OPPOSITION TO NEW ENGLAND COALITION'S MOTION TO EXTEND TIME Pursuant to 10 C.F.R. §2.323(c) and the directive of the Atomic Safety and.Licensing Board ("Board"), see Order (Setting Deadline for Answers to NEC Motion to Extend Time) dated June 19, 2007, Applicants Entergy Nuclear Vermont Yankee, LLC and Entergy Nuclear Operations, Inc. (collectively "Entergy") provide this Response in opposition to New England Coalition, Inc. ("NEC")'s "Motion to Extend Time for NEC's Opposition to Entergy's Motion for Summary Disposition of New England Coalition's Contention 4 (Flow Accelerated Corrosion") ("NEC Motion"). NEC's motion is unsupported and should be denied.

NEC seeks a twenty day extension, beyond the twenty days allowed by 10 C.F.R. § 2.1 205(b), to respond to Entergy's Motion for Summary Disposition of New England Coalition's Contention 4 (Flow Accelerated Corrosion) ("Entergy's Sumnmary Disposition Motion"), filed on June 5, 2007.1 NEC claims it needs this additional time for two reasons: (1) because NEC's consultants need additional time to review "numerous" documents relevant to NEC Contention 4 that Entergy produced as part of its Seventh Supplemental Disclosure, on June 7, 2007; and (2) because NEC's consultants "are hindered by difficulties The requested period includes one week of vacation that NEC Counsel intends to take.

locating information among the large volume of documents Entergy has produced to NEC as non-text-searchable electronic image files." NEC Motion at 1-2. Neither alleged reason is valid.

Entergy produced only on document relevant to NEC Contention 4 as part of its June 7, 2007 Supplemental Disclosure: Dr. Jeffrey Horowitz's four-page "Summary of Observations During VY Site Visit" dated May 29, 2007.2 That document had already been provided to NEC, since it was Exhibit 3 to ilie "Joint Declaration of Jeffrey S. Horowitz and James C. Fitzpatrick in Support of Entergy's Motion for Summary Disposition~of NEC Contention 4", dated May 31, 2007 and was included with Enitergy's Summary Disposition Motion. It taxes credulity to' assert, as NEC does, that it needs a total of forty days to review a single, self-explanatory four-page document. 3 NEC's claim regarding "the large volume of documents" relevant to NEC Contention 4 that it allegedly needs to review is also grossly exaggerated. Entergy has produced a total of 190 documents relevant to NEC Contention 4 since the contention was admitted.4 See Exhibit 1 hereto. The first 130 of those documents (two-thirds of them), were produced with the initial disclosures on October 23, 2006, almost eight months ago. Id. NEC008877); Ref. 14: produced on Dec. 7, 2006 (Bates Nos. NEC017817 - NEC017850). Ref. 13, a twelve-page Entergy Nuclear Northeast procedure on component scanning and gridding, was mistakenly not produced previously but was e-mailed today.

NEC does not need to review these documents to respond to Entergy's Summary Disposition Motion, but assuming arguendo that it does, it has had all but one 12-page document for some time.

prdduced in the first supplemental discovery on December 7, 2006, over six months ago. Id. In othei words, NEC has had 181 out of the 190 documents relevant to Contention 4 since last year, and has had that much time to review all butrnine of the discovery documents relevant to the contention. Surely, NEC could have. easily ieviewed those documents had it applied itself to the task.

• Of the remaining nine documents, eight were produced on May 3, 2007.5 They total a combined one hundred and sixty three (I163)'pages, and have. been available to NEC for a month atid'a half. Id. As previously stated, Entergy's supplemental disclosure on June 7, 2007 provided only one additional documrent relevant to Contention 4 - the above-mentioned four page '"Summaryof Observations During VY Site Visit." Thus, NEC aiid its consultants do not*

have -a"large volume" of documents to revie'w - they have had to review only nin documents relevant to Contention 4 this entire year, totaling well under 170 pages. Such a modest review burden cannot credibly be the basis for seeking an extension of time.

Moreover, if at any point since October 2006 NEC had experienced difficulty reviewing' or locating a particular document or documents, it could have asked Entergy for assistance or, if such help was unavailing, have sought the Board's intervention. 6 NEC has failed to do so until yesterday's motion, which should be denied as untimely as well as for lacking basis because under 10 C.F.R. § 2.323 (a) a motion "must be made no later than ten (10) days after the occurrence or circumstance from which the motion arises." This software produces the documents on compact disk in image format so that each page may contain a bates-stamp number and conform to the original. It also provides a searchable index of the titles of the documents on each CD, from which each document may be accessed. All CDs that contain discovery documents for NEC Contentions 2-4 include such an index. NEC has received the disclosed documents in this format for the last eight months, but has never complained until Entergy's Summary Disposition Motion was filed.

In sumniary, NEC's Motion strongly suggests that NEC simply made no attempt to even look at any of Entergy's disclosures with respect to NEC Contention 4 until it received Entergy's Summary Disposition Motion. Any difficulties NEC may be encountering are, therefore, of its own making.

For the above described reasons NEC's MotioA is lacking in merit and should be denied.
