NRC STAFFS ANSWER TO ENTERGYS MOTION TO STRIKE NEW ENGLAND COALITIONS REPLY TO NRC STAFF AND ENTERGY OPPOSITIONS TO NECS MOTION TO FILE A TIMELY NEW CONTENTION Pursuant to 10 C.F.R. § 2.323(c), the staff of the U.S. Nuclear Regulatory Commission (NRC Staff) hereby responds Entergys Motion to Strike New England Coalitions Reply to NRC Staff and Entergy Oppositions to NECs Motion to File a Timely New Contention, filed June 2, 2009. In that motion, Entergy states that it consulted with the parties in advance of filing without stating what position the NRC Staff had taken. In accordance with 10 CFR 2.323(b) and the Boards November 17, 2006 Order, the NRC Staff is filing this response to clarify that the NRC Staff responded to Entergys request for consultation and did not oppose the motion but reserved the right to respond.
The NRC Staff confirms that it received New England Coalitions Reply in an envelope with a label indicating that New England Coalition purchased the postage at the Post Office on May 27, 2009, one day after New England Coalition claims to have mailed the Reply in its Certificate of Service.
