MF9573) Dear Mr. Curtland: By letter dated October 18, 2017 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML17212A646), the U.S. Nuclear Regulatory Commission (NRC) issued Amendment No. 301 to Renewed Facility Operating License No. DPR-49 for the Duane Arnold Energy Center (DAEC). The amendment revised the Duane Arnold Energy Center (DAEC) Plume Exposure Pathway Emergency Planning Zone (EPZ) in its Emergency Preparedness Plan. The Evacuation Time Estimates Study was also revised to encompass the changes to the Plume Exposure Pathway EPZ boundary. The NRC identified that the number assigned to the DAEC EPZ amendment (Amendment No. 301) was in error and it should have been Amendment No. 302. This error occurred due to issuance of a DAEC Emergency Plan amendment (ADAMS Accession No. ML 17220A026) as Amendment No. 301 on September 21, 2017, ahead of the EPZ amendment. Issuing the DAEC EPZ amendment with the incorrect amendment number was an administrative oversight which is being corrected via this letter. The guidance in SECY-96-238 allows for use of an administrative letter to correct an error provided that: 1) the error was introduced inadvertently in a particular license amendment, and 2) the erroneous change was not addressed in the notice to the public nor reviewed by the NRC staff. The NRG staff determined that the error inadvertently occurred in the numbering of the license amendment to change the EPZ boundary as No. 301. This satisfies the first requirement. The amendment number was not included in the original submittal, was not identified in the notice on the amendment published in the Federal Register (82 FR 46541 ), and was not the subject of any specific part of the staff's safety evaluation that was issued with the license amendment. This satisfies the second requirement. Based on our review, as set forth above, we have determined that the use of a letter to correct the typographical error is acceptable.
