CORRECTION LETTER: DUANE ARNOLD ENERGY CENTER - ISSUANCE OF LICENSE AMENDMENT NO. 303 RE: REVISION TO TECHNICAL SPECIFICATION TABLE 3.3.2.1-1, CONTROL ROD BLOCK INSTRUMENTATION (CAC NO. MF9494, EPID L-2017-LLA-0190)

Dear Mr. Curtland:

By letter dated March 7, 2018, 1 the U.S. Nuclear Regulatory Commission (NRC) issued Amendment No. 303 to Renewed Facility Operating License No. DPR-49 for the Duane Arnold Energy Center (DAEC). The license amendment request (LAR) revised technical specification (TS) Table 3.3.2.1-1, "Control Rod Block Instrumentation." The revised TS relocates cycle-specific minimum critical power ratio (MCPR) values specified in footnotes (a) through (e) for Function 1, Rod Block Monitor, from TS Table 3.3.2.1-1 to the DAEC core operating limits report (COLR). It also corrected a typographical error and added TS requirement item a.4 to the DAEC TS 5.6.5, COLR, which addresses the relocation of the MCPR values.

Shortly following a post-issuance review by a member of your staff, the NRC project manager assigned to DAEC, was informed that the implementation requirement included in the amendment does not align with what NextEra requested in the LAR dated March 24, 20172

  • Specifically, the 180 days the NRC granted for implementation of the amended change does not meet DAEC's schedule to complete the next Core Operating Limits Report (COLR). The following corrected implementation requirement is included in the enclosure to this letter:
3. This license amendment is effective as of its date of issuance and shall be implemented by September 27, 2018.

The guidance in SECY-96-238 allows for use of an administrative letter to correct an error provided that: 1) the error was introduced inadvertently in a particular license amendment, and

2) the erroneous change was not addressed in the notice to the public nor reviewed by the NRC staff. The NRC staff determined that the error occurred when the licensee's requested implementation date was not correctly included in the amendment issuance package. This satisfies the first requirement. The incorrect implementation date was not included in the original submittal, was not identified in the notice on the amendment published in the Federal Register (82 FR 23627, dated May 23, 2017), and was not the subject of any specific part of the staffs safety evaluation that was issued with the license amendment. This satisfies the second requirement.

D. Curtland Based on our review, as set forth above, we have determined that the use of a letter to correct the typographical error is acceptable. Additionally, a corrected Notice of Issuance will be included in the Commission's next biweekly Federal Register notice.

1. The U.S. Nuclear Regulatory Commission (the Commission) has found that:

A. The application for amendment by NextEra Energy Duane Arnold, LLC dated March 24, 2017, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission's rules and regulations set forth in 10 CFR Chapter I; B. The facility will operate in conformity with the application, the provisions of the Act, and the rules and regulations of the Commission; C. There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commission's regulations; D. The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; and E. The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commission's regulations and all applicable requirements have been satisfied.

2. Accordingly, the license is amended by changes to the Operating License and Technical Specifications as indicated in the attachment to this license amendment and paragraph 2.C.(2) of Renewed Facility Operating License No. DPR-49 is hereby amended to read as follows:

(2) Technical Specifications The Technical Specifications contained in Appendix A, as revised through Amendment No. 303, are hereby incorporated in the license. NextEra Energy Duane Arnold, LLC shall operate the facility in accordance with the Technical Specifications.

3. This license amendment is effective as of its date of issuance and shall be implemented by September 27, 2018.
