DUANE ARNOLD ENERGY CENTER - CORRECTION TO THE RENEWED FACILITY OPERATING LICENSE TO REFLECT LICENSE CONDITIONS REMOVED BY PREVIOUS LICENSE AMENDMENTS

Dear Mr. Coffey:

The U.S. Nuclear Regulatory Commission (NRC) staff is reissuing the attached Page Nos. 3 and 4 for the NextEra Energy Duane Arnold, LLC (NEDA) Duane Arnold Energy Center (DAEC)

Renewed Facility Operating License No. DPR-49 (DAEC License). The reissued license pages correct for the previous inadvertent removal of License Condition 2.C.(8), regarding changes to the Updated Final Safety Analysis Report; License Condition 2.C.(9), regarding mitigation strategy; and License Condition 2.C.(10), regarding compliance with NRC Order EA-06-137, from the DAEC License.

These three license conditions were evaluated and approved by the NRC for removal from the DAEC License by Amendment No. 314 and Amendment No. 315. Amendment No. 314 was issued by the NRC on May 13, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21067A642); Amendment No. 315 was issued by the NRC on January 21, 2022 (ADAMS Accession No. ML21172A217). However, the three license conditions were inadvertently reintroduced into the DAEC License with the amendment pages the NRC issued to accompany Amendment No. 316 and Amendment No. 317 to the DAEC License. Amendment No. 316 was issued by the NRC on February 3, 2022 (ADAMS Accession No. ML22028A282); Amendment No. 317 was issued by the NRC on March 10, 2022 (ADAMS Accession No. ML22059A746).

The inclusion of these three license conditions in the DAEC license pages issued with Amendment No. 316 and Amendment No. 317 was an administrative error on the part of the NRC staff and does not reflect the current licensing basis or associated conditions applicable to the DAEC facility at this stage in the decommissioning process (i.e., all spent fuel removed from the DAEC spent fuel pool and stored within the onsite independent spent fuel strange installation (ISFSI). As such, Page Nos. 3 and 4 of the DAEC License are being reissued to correct this administrative error.

B. Coffey The removal of License Conditions 2.C.(8), 2.C.(9), and 2.C.(10) from the DAEC License is administrative in nature to remedy a previous error introduced by the NRC staff. The corrected version of Page Nos. 3 and 4 of the DAEC License is attached and reflects the information that should have been issued by the NRC as part of the pages issued with Amendment No. 317 to the DAEC License. Replacement of the current Page Nos. 3, 4, and 5 of the DAEC License with the attached corrected pages will ensure that the facility has a correct and current license document.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. C. This renewed operating license shall be deemed to contain and is subject to the conditions specified in the following Commission regulations in 10 CFR Chapter I; Part 20, Section 30.34 of Part 30, Section 40.41 of Part 40, Sections 50.54 and 50.59 of Part 50, and Section 70.32 of Part 70; is subject to all applicable provisions of the Act and to the rules, regulations, and orders of the Commission now or hereafter in effect; and is subject to the additional conditions specified or incorporated below:

(1) Deleted (2) Technical Specifications The Technical Specifications contained in Appendix A, as revised through Amendment No. 317, are hereby incorporated in the license. NextEra Energy Duane Arnold, LLC shall operate the facility in accordance with the Permanently Defueled Technical Specifications.

(3) Deleted (4) Deleted (5) Physical Protection NextEra Energy Duane Arnold, LLC shall fully implement and maintain in effect all provisions of the Commission-approved physical security, training and qualification, and safeguards contingency plans including amendments made pursuant to 10 CFR 72.212(b)(9) and to the authority of 10 CFR 50.90 and 10 CFR 50.54(p). The combined set of plans, which contains Safeguards Information protected under 10 CFR 73.21, is entitled: Duane Arnold Energy Center Physical Security Plan, submitted by letter dated June 3, 2021, as supplemented.

(6) Deleted (7) Additional Conditions The Additional Conditions contained in Appendix B, as revised through Amendment No. 315, are hereby incorporated into this license. NextEra Energy Duane Arnold, LLC shall operate the facility in accordance with the Additional Conditions.

D. This license is effective as of the date of issuance and is effective until the Commission notifies the licensee in writing that the license is terminated.
