NUCLEAR REGULATORY COMMISSION

OFFICE OF NUCLEAR SECURITY AND INCIDENT RESPONSE

WASHINGTON, DC 20555 April 20, 2006 NRC REGULATORY ISSUE SUMMARY 2006-05 WITHDRAWAL OF TRANSPORTATION SAFEGUARDS ADVISORIES

SA-01-01, Rev. 1 and SA-03-02

ADDRESSEES

Licensees who transport, or deliver to a carrier for transport, radioactive material in quantities of concern.

INTENT

The NRC is issuing this regulatory issue summary (RIS) to notify affected parties that the transportation safeguards advisories SA-01-01, Rev. 1 and SA-03-02 are withdrawn. No specific action or written response is required.

BACKGROUND

Following the events of September 11, 2001, the NRC staff issued safeguards advisories (SAs)

to various licensees transporting certain radioactive materials. Two such advisories, SA-01-01, Rev. 1 and SA-03-02, provide guidance to the industry and include the NRCs expectations for enhanced security in the current threat environment.

The NRC staff issued Orders to both NRC and Agreement State licensees to implement enhanced transportation security requirements for radioactive materials in quantities of concern (RAMQC). Licensees were required to comply with the Orders by the specified dates.

SUMMARY OF ISSUE

S

The measures imposed by the RAMQC Orders include the primary measures in SA-01-01, Rev. 1 and SA-03-02 , and the advisories are no longer necessary. These Orders were issued to licensees that notified the NRC of their intention to transport RAMQC. As NRC becomes aware of additional licensees intention to transport RAMQC, the NRC will issue Orders accordingly.

The NRC withdraws transportation safeguards advisories SA-01-01, Rev. 1 and SA-03-02, effective immediately.

BACKFIT DISCUSSION

This RIS does not require any action that would involve a backfit; therefore, the NRC staff did not perform a backfit analysis.
