In accordance with the requirements of 10 CFR 73.5, Southern Nuclear Operating Company (SNC) requested in letter dated June 9, 2009 that the Nuclear Regulatory Commission (NRC) approve an exemption from specific -

requirements of 10 CFR Part 73, "Physical Protection of Plants and Materials" for the Joseph M. Farley Nuclear Plant (FNP) Units 1 and 2 by extending the deadline for the implementation of certain measures required by the new rule from March 31, 2010 to December 15, 2010. In telecons with the NRC Staff, additional information was requested to support the exemption request.

SNC requests approval of this exemption request by August 15, 2009 so that appropriate and timely actions can be taken to revise and implement the FNP security program. The proposed exemptions are requested to be effective upon issuance.

Enclosure 1 provides the additional physical and programmatic security information requested by the NRC Staff to support the exemption request. The information provided in Enclosure 1 is considered security-related information associated with physical protection of SNC operated facilities, as described in 10 CFR 2.390(d)(1). Accordingly, SNC requests that the information provided in Enclosure 1 be withheld from public disclosure in accordance with the provisions of 10 CFR 2.390. As requested, the compensatory measures that would be used after March 31, 2010 until FNP is in compliance with the new Part 73 requirements are provided in Enclosure 2. The information provided in Enclosure 2 contains safeguards information. Enclosure 3 contains the environmental assessment for the security changes requested in the proposed exemption.

Enclosure 4 is the non-proprietary version of Enclosure 1.
