In Reference 1, NextEraTMEnergy Duane Arnold, LLC, flWa FPL Energy Duane Arnold, LLC (hereafter, NextEra Energy Duane Arnold) submitted Technical Specification Change Request TSCR-107. The proposed amendment will delete the Duane Arnold Energy Center (DAEC) Technical Specification (TS) Section 5.2.2.e regarding work hour controls.

In Reference 1, NextEra Energy Duane Arnold identified a typographical error that was believed to be in TS 5.2.2.d on TS page 5.0-3. The stated correction would have deleted the letter "d" in the word "provided such that the affected phrase starting in the third line of TS 5.2.2.d would have become "... in order to provide for unexpected absence ..." NextEra Energy Duane Arnold withdraws its request for correction of the typographical error, noting that the docketed version of the current License and Technical Specifications (ML053050309) does not contain this typographical error in TS 5.2.2.d. The current phrase in document ML053050309 is "... in order to provide for unexpected absence ..." The information and conclusions provided in Reference 1 and in Federal Register Notice dated March 24, 2009 (74FR12393) are not changed by this withdrawal.

NextEra Energy Duane Arnold requests approval of the proposed license amendment of Reference 1 by September 1, 2009 to support implementation of TS changes concurrent with implementation of the new 10 CFR 26, Subpart I requirements by October 1, 2009 This letter contains no new commitments nor revises any previous commitments.
