Pursuant to 10CFR50.91(b) State consultation, I am notifying you that we are processing an amendment to the license of the Duane Arnold Energy Center (DAEC) that revises Technical Specifications (TS) Section 5.2.2, Unit Staff, to delete the text of paragraph "e." After the change TS 5.5.2.e will state "Not used."
The deleted text pertains to work hour controls to address worker fatigue worker that could adversely affect public health and safety and the common defense and security. The deletion applies NRC approved Revision 0 toTechnical Specification Task Force (TSTF) Improved Standard Technical Specification Change Traveler, TSTF-511, Eliminate Working Hour Restrictions from TS 5.2.2 to Support Compliance with 10 CFR Part 26. The licensee committed to implement the new requirements of 10 CFR Part 26, Subpart I concurrently with the deletion of the TS requirements on work hour controls.
The amendment is described in a Duane Arnold Energy Center application letter dated January 30, 2009 and in a Federal Register Notice (74 FR 12390) dated March 24, 2009. In the same application letter DAEC requested the correction of an unrelated grammatical typographical error on the same TS page in paragraph 5.2.2.d. On July 30, 2009, in a supplemental letter DAEC withdrew its request for correction of the typographical error, noting that the docketed version of the current License and Technical Specifications (ADAMS Accession Number
ML053050309) does not contain this typographical error. The information and conclusions provided in the application and in Federal Register Notice are not changed by the withdrawal.
