AMENDMENT 107 - APPROVAL OF LICENSE AMENDMENT REQUEST 24-04, LICENSING AMENDMENT FOR THE URENCO USA STANDARD PRACTICE PROCEDURE PLAN FOR THE PROTECTION OF CLASSIFIED MATTER (ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2025-SPR-0000) AND APPROVAL TO REASSIGN FOREIGN OBLIGATIONS FOR LOW ENRICHED URANIUM INVENTORY
Dear Paul Lorskulsint:
By letter dated December 17, 2024 (Agencywide Documents Access and Management System
[ADAMS] Accession No. ML24352A488), Louisiana Energy Services, LLC (LES), dba Urenco USA (UUSA), requested the U.S. Nuclear Regulatory Commission (NRC) approval of the UUSA Standard Practices Procedure Plan (SPPP) for the Protection of Classified Matter. LES provided supplemental information by letter dated February 7, 2025 (ML25040A002). The new SPPP would replace existing licensing basis documents listed in its special nuclear materials (SNM) license 2010 (SNM-2010), License Condition 10.h.
The NRC staff has completed its review of the above submittals and finds that the changes proposed are in accordance with the requirements of Title 10 of the Code of Federal Regulations (10 CFR) Part 95 and 32 CFR Part 117 and provides reasonable assurance that UUSA will adequately protect classified matter and sensitive information in its possession. Prior to implementation of the updated classified boundary, NRC staff must complete an operational readiness review (ORR) and UUSA must receive a final inspection report from Region II.
Therefore, license amendment request 24-04 is approved contingent upon successful completion of an ORR. Enclosure 1 is the security evaluation report that documents the NRC staffs review. Enterprise Project Identification number L-2025-SPR-0000 is considered closed.
Sub-paragraph h to License Condition 10 of SNM-2010 will be amended as follows:

Standard Practice Procedure Plan for the Protection of Classified Matter dated December 12, 2003, as revised by correspondence dated July 30, 2004; March 16, 2006; November 21, 2006; November 22, 2006; March 20, 2007; Enclosures 1 and 2 transmitted with this letter contain Security Related Information. When separated from Enclosures 1 and 2, this letter and Enclosure 3 are decontrolled.

Constraint to License Condition 10.h Prior to implementation of the updated classified boundary as detailed by the December 17, 2024, and February 7, 2025 submittals, NRC staff must complete an ORR and UUSA must receive a final inspection report from Region II.
Additionally, by letter dated August 20, 2024 (ML24233A310), UUSA requested prior written approval from the NRC to reassign foreign obligations for its uranium inventory. The NRC staff (1) evaluated the request in consultation with its U.S. Government interagency partners, the Department of State and Department of Energy/National Nuclear Security Administration and, (2) approved the request finding UUSA demonstrated it will meet the core principles for tracking foreign obligations on low enriched uranium in a letter dated April 8, 2024 (ML24344A066). The NRCs letter stated that prior governmental approval to continue assigning and tracking foreign obligations on its uranium inventory would be effective upon issuance of Amendment 107.
Materials License SNM-2010 is amended by the addition of License Conditions SG-2.6 as follows:
SG-2.6 UUSA is authorized to exchange foreign obligations between similar materials as needed for routine licensed activities as described in letter dated August 20, 2024 (ML24233A310).
Additionally, License Condition SG-2.5, which required government approval to reassign foreign obligations, will be deleted because of the April 8, 2024, approval for tracking foreign obligations.
The above changes are documented in Amendment 107 to UUSA Materials License SNM-2010 and are attached to this letter as Enclosures 2 and 3.
Because all the activities noted above involve administrative actions, the NRC staff determined that the proposed activities do not individually or cumulatively have a significant effect on the human environment. Therefore, in accordance with 10 CFR Paragraph 51.22(c)(11), neither an Environmental Assessment nor an Environmental Impact Statement is warranted for this action.
In accordance with 10 CFR Part 2 Agency Rules of Practice and Procedure, a copy of this letter and Enclosure 3 will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records component of NRCs ADAMS.
