APPROVAL OF AMERICAN CENTRIFUGE OPERATINGS REQUEST FOR EXEMPTION FROM CERTAIN REQUIREMENTS OF 10 CFR 70.24(a):

AMENDMENT 28 OF SPECIAL NUCLEAR MATERIALS LICENSE NUMBER SNM-2011 (ENTERPRISE PROJECT IDENTIFICATION: L-2024-LRM-0078)

Dear Kelly L. Fitch:

In accordance with your amendment request dated May 9, 2024 (Agencywide Documents Access and Management System (ADAMS) Accession Number ML24135A293), supplements dated October 17, 2024 (ML24299A081) January 2, 2025, ML25015A113), and January 30, 2025 (ML ML25037A128) and pursuant to Part 70 to Title 10 of the Code of Federal Regulations (10 CFR), Special Nuclear Materials License SNM-2011 is hereby amended to exempt American Centrifuge Operating, LLC (ACO) from the requirements of 10 CFR 70.24(a) for certain cascade operations of the American Centrifuge Plant (ACP).

The details associated with the U.S. Nuclear Regulatory Commissions (NRCs) review are documented in the enclosed safety evaluation report (SER). The enclosed Amendment 28 to License SNM-2011 will become effective on the date of this letter.

As part of this licensing action, the following amendments to License SNM-2011 are being made:

(1) LC 10.b has been modified to incorporate the changes made to the Emergency Plan (NR-3605-0008) consistent with ACOs submittal dated May 9, 2024.

Enclosures 1 and 2 transmitted herewith contain sensitive security related and proprietary information. When separated from the sensitive conditions in Enclosure 1 and 2, this document and Enclosure 3 are decontrolled.

OFFICIAL USE ONLY SECURITY - RELATED INFORMATION (2) LC 10.e has been modified to incorporate the changes made to the License Application (LA-3605-0001) consistent with ACOs submittal dated May 9, 2024, and its updates submitted on October 17, 2024, January 2, 2025, and January 30, 2025.

(3) A new LC 32 was added to incorporate ACOs exemption request as follows:

License Condition 32 ACO is exempted from the requirements of 10 CFR 70.24(a) insofar as such requirements apply to the following:

a.

the handling, storage, and transportation (on-site transportation of 30-series feed cylinders received from an NRC licensed shipper) of High Assay Low Enriched Uranium Demonstration 30-series cylinders containing less than or equal to 5.0 weight percent uranium-235; b.

operations involving special nuclear material less than 1 weight percent uranium-235 or below 100 grams uranium-235 (i.e., non-fissile material operations);

c.

areas in which the licensee determines criticality is not credible. Determinations of not credible require, at a minimum, that, under normal and credible abnormal conditions, inventory is below 700 grams uranium-235 and massive moderators or reflectors made of graphite, heavy water, or beryllium are not present; d.

the storage of special nuclear material contained in packages as defined in 10 CFR Part 71 or specifically exempt according to 10 CFR 71.15, provided fissile exempt packages are limited to the size and configuration of the transport conveyance and fissile packages are limited to a criticality safety index (CSI) of 100, fissile exempt packages and fissile packages are not stored in the same area or are otherwise commingled, and at least 6 meters of spacing is maintained between areas; and e.

planned events in which the criticality accident alarm system (CAAS) or its associated equipment is out of service, provided compensatory measures are employed and remain effective until the CAAS has been restored to service.

All other conditions of this license will remain the same. Enclosed are copies of the revised Materials License SNM-2011and the SER.

This letter and the enclosed amendment closes efforts under Enterprise Project Identification Number L-2024-LRM-0078.
