APPROVAL OF AMERICAN CENTRIFUGE OPERATINGS REQUEST TO EXTEND PHASE II OF ITS HIGH-ASSAY LOW-ENRICHED URANIUM OPERATIONS AT THE AMERICAN CENTRIFUGE PLANT IN PIKETON, OHIO (ENTERPRISE PROJECT IDENTIFIER L-2024-LRM-0078)

Dear Kelly L. Fitch:

By letter dated September 12, 2024, (Agencywide Documents Access and Management System [ADAMS] Accession No. ML24262A084), American Centrifuge Operating, LLC (ACO), a wholly owned subsidiary of Centrus Energy Corp., requested review and approval of proposed changes to its license application and supporting documents for the American Centrifuge Plant (ACP) located in Piketon, Ohio. The U.S. Nuclear Regulatory Commission (NRC) accepted the application for detailed review on October 21, 2024 (ML24298A160).

ACO supplemented the September 12, 2024, application on November 7, 2024 (ML24324A321). On November 15 and 20, 2024, the NRC staff conducted two conference calls with ACO to discuss a new license condition (LC) that would require ACO to provide the NRC prior notification of changes to ACOs high-assay low-enriched uranium (HALEU) contract with the U.S. Department of Energy (DOE) that are material to the ACP License SNM-2011 (ML24331A050). By letter dated November 21, 2024 (ML24331A050), ACO supplemented its September 12, 2024, application by proposing the following new LC:

ACO shall provide at least a 30-day prior written notification to the NRC of anticipated or needed changes to its HALEU Demonstration contract that are material to ACOs license, including contract completion date extensions. Such written notifications shall include the anticipated or needed changes to the contract and the status of DOEs review with respect to a proposed change. If it is not possible for ACO to provide the 30-day prior notification, ACO shall provide the prior notification before the change is made, and as early as possible, with an explanation of why the required 30-day notification time period could not be met.

Enclosures 1 and 2 transmitted herewith contain sensitive security related information.

When separated from the sensitive conditions in Enclosures 1 and 2, this document and Enclosures 3 and 4 are decontrolled.

OFFICIAL USE ONLY - SECURITY RELATED INFORMATION The NRC staff has completed its review of the September 12, 2024 request and supplements, dated November 7, 2024, and November 21, 2024. The details associated with the review are documented in the enclosed safety evaluation report (SER). The enclosed Amendment 27 to License SNM-2011 will become effective on January 1, 2025. The Environmental Assessment (ML24345A197) associated with this license amendment was issued on December 26, 2024, and published in the Federal Register on December 31, 2024 (ML24358A175).

As part of this licensing action, the following amendments to License SNM-2011 are being made:

(1) LC 10.c has been modified to incorporate the changes made to the Environmental Report (LA-3605-0002) consistent with ACOs submittal dated September 12, 2024.

(2) LC 10.d has been modified to incorporate the changes made to the Fundamental Nuclear Material Control Plan (NR-3605-0005) consistent with ACOs submittal dated September 12, 2024.

(3) LC 10.e has been modified to incorporate the changes made to the Security Plan for the Protection of Classified Matter (SP-3605-0041) consistent with ACOs submittal dated September 12, 2024.

(4) LC 10.s been modified to incorporate the substantial changes made to the License Application (LA-3605-0001) consistent with ACOs submittal dated September 12, 2024, and its update submitted on November 21, 2024.

(5) LC 10.y has been modified to incorporate the changes made to the Security Plan for the Physical Protection of Special Nuclear Material at the American Centrifuge Plant in Piketon, Ohio (SP-3605-0042) consistent with ACOs submittal dated September 12, 2024.

(6) LC 15 has been modified by removing the termination date of the DOE-ACO HALEU contract.

(7) A new LC 31 was added to incorporate ACOs proposed LC.

It is noted that certain changes made to LA-3605-0002 and LA-3605-0001 and all changes made to NR-3605-0005, SP-3605-0041 and SP-3605-0042 were non-substantial and therefore did not require NRC review and approval.
