SUMMARY
OF JANUARY 23, 2024, MEETING WITH NUCLEAR ENERGY INSTITUTE CONCERNING NEI 20-07, DRAFT REVISION E (EPID L-2023-NFN-0012)
On January 23, 2024, a closed public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Nuclear Energy Institute (NEI) at NRC headquarters in Rockville, Maryland. The main purpose of the meeting was for NEI to provide an overview of Draft Revision E of NEI 20-07, Guidance for Addressing Common Cause Failure in High Safety-Significant Safety-Related Digital I&C Systems, to the NRC staff. NEI provided the draft document to the NRC in a letter dated July 24, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23205A188). The other purpose of the meeting was to provide NEI with the status of the NRC staffs review of NEIs withholding request for Draft Revision E of NEI 20-07. The meeting notice and agenda, dated December 19, 2023, are available in the ADAMS at Accession No. ML23353A055. A list of attendees is provided in the enclosure.
The NEI representatives provided an overview of the methodology in and the content of each section of the draft document. The NEI representatives stated the methodology described in the draft document is technology agnostic and is intended to be used for both operating reactors and advanced reactors. The NEI representatives stated that the Electric Power Research Institutes processes included in the methodology described in the draft document have not been endorsed or approved by the NRC.
In response to a question from NEI about biggest challenge with obtaining NRC endorsement or approval of NEI 20-07 by the end of the calendar year, the NRC staff informed the NEI representatives that the draft document would need to be finalized and submitted to the NRC for review. The NEI representatives did not provide a target date for finalizing and submitting the document for review.
The NRC staff informed the NEI representatives of the criteria from the regulations used to perform review of requests to withhold information from the public. The NRC staff informed the NEI representatives that the review of the NEI withholding request was nearly complete, and a decision would be issued in early February 2024.
No regulatory decisions were made during the meeting. Members of the public were not in attendance. Public Meeting Feedback forms were not received.
