AGENCY: Nuclear Regulatory Commission.

ACTION: Notice; issuance.

SUMMARY

The U.S. Nuclear Regulatory Commission (NRC) reviewed an appli cation

by Northern States Power Company (NSPM) for amendment of Specia l Nuclear

Materials License No. SNM-2506 which authorizes NSPM to receive, possess, store,

and transfer spent nuclear fuel and associated radioactive mate rials. The amendment

request sought to revise the technical specifications (TS) for the Prairie Island

Independent Spent Fuel Storage Installation (PI ISFSI) to allow use of a Code alternative

as an option to the requirements of the 2004 Edition through 20 06 Addenda of the

American Society of Mechanical Engineers (ASME) Boiler and Pres sure Vessel (B&PV)

Code,Section III, Division 1, Subsection NB, Paragraph NB-5130, by revising the TS to

add the Code alternative to TS section 4.4, table 4.4-1, TN-40H T ASME Code

Exceptions.

SUPPLEMENTARY INFORMATION:

The NRC received, by [[letter::L-PI-23-018, License Amendment Request to Revise ISFSI Technical Specification 4.4 to Allow Use of a Code Alternative to ASME Code, NB-5130, Examination of Weld Edge Preparation Surfaces, for the TN-40HT|letter dated July 14, 2023]] (ADAMS Accessi on No.

ML23195A187), a license amendment application from NSPM, to ame nd Special

Nuclear Materials License No. SNM-2506, which authorizes the st orage of spent fuel at 2

the PI ISFSI located in Welch, Minnesota. Specifically, the ame ndment sought to revise

the TS to allow use of a Code alternative as an option to the r equirements of the 2004

Edition through 2006 Addenda of the American Society of Mechani cal Engineers

(ASME) Boiler and Pressure Vessel (B&PV) Code,Section III, Div ision 1, Subsection

NB, Paragraph NB-5130, by revising the TS to add the Code alter native to TS section 4.4, table 4.4-1, TN-40HT ASME Code Exceptions.

An NRC administrative completeness review, documented in a lett er to NSPM

dated August 24, 2023 (ADAMS Accession No. ML23234A135), found the application

acceptable to begin a technical review. In accordance with sect ion 72.16 of title 10 of the

Code of Federal Regulations (10 CFR), a notice of docketing was published in the

Federal Register on September 8, 2023 (88 FR 62108). The notice of docketing in cluded

an opportunity to request a hearing and to petition for leave t o intervene. No requests for

a hearing or petitions for leave to intervene were submitted.

The NRC prepared a safety evaluation report (SER) (ADAMS Access ion No.

ML24008A131) to document its review and evaluation of the amend ment request. In

addition, the NRC evaluated an assertion by NSPM that the amend ment request

satisfied the categorical exclusion criteria specified in 10 CF R 51.22(c)(11). Under

10 CFR 51.22(c)(11), a categorical exclusion is allowed for ame ndments to materials

licenses which are administrative, organizational, or procedura l in nature, or which result

in a change to process operations or equipment, provided that ( i) there is no significant

change in the types or significant increase in the amounts of a ny effluents that may be

released offsite, (ii) there is no significant increase in indi vidual or cumulative

occupational radiation exposure, (iii) there is no significant construction impact, and (iv)

there is no significant increase in the potential for or conseq uences from radiological

accidents. As explained in the SER, the NRC determined that the license amendment 3

satisfied the 10 CFR 51.22(c)(11) categorical exclusion criteri a. Consequently, an

environmental assessment and findi ng of no significant impact are not required.

Upon completing its review, the NRC staff determined that the r equest complies

with the standards and requirements of the Atomic Energy Act of 1954, as amended (the

Act), as well as the NRCs rules and regulations. The Commission has made appropriate

findings as required by the Act and the Commissions rules and regulations in

10 CFR chapter I, which are set forth in the license amendment. The NRC approved and

issued Amendment No. 12 to Special Nuclear Materials License No. SNM-2506

(ML24008A130), held by NSPM for the receipt, possession, transf er, and storage of

spent fuel and associated radioactive materials at the PI ISFSI. Pursuant to 10 CFR

72.46(d), the NRC is providing notice of the action taken. Amen dment No. 12 was

effective as of the date of issuance, March 5, 2024.
